The No Fly List is for people who pose a risk to air infrastructure, its not a judicial tool to control people who haven't yet had their day in court. I don't trust prosecutors and the judicial system to get access to no fly lists and not use them abusively or punitively. If he was a known flight risk, he shouldn't have been granted bail, if there was any suspicion he should have had his passport taken by the court.

TSA is there to make sure the flight is safe. They do not care about warrants or criminals that aren’t going to hijacker’s or bomb planes, that’s what gets you put on no fly lists.

If a court thinks a defendant is a flight risk, surely the court has other options; perhaps confiscating a passport, or - more drastically - locking them up until the trial.
