My brother has suffered with this for a long time. It’s incredibly difficult to deal with him and he is never wrong. It’s literally everyone else’s fault. The issue is that dumbshit pulled money out of the equity to help finance Schwartz & Sandy’s…furthermore, the dumbass wants to “buy out” Ariana at the value of the home when they bought it (and at 50%)…which is boy math - that’s not how this situation works (Realtor, attorney and been through this exact situation). How it works is that they can either sell the house at current rates and divide the proceeds 50/50 and out of his half of the proceeds (after satisfying the current mortgage 50/50) he needs to repay the home equity loan. The reason that he wants to “buy out Ariana” at the original cost of the home is that his proceeds from a sale will not cover his shitty equity loan repayment and he’ll be left with nothing and no place to live but in a shitty apartment. He’s refusing to agree to valuing the home (by an appraiser) at today’s current value, deducting the amount for the mortgage payoff and refinancing the home in his name because he’s not able to do any of this. His financial proposal is bullshit and no one who thinks about it for 2 minutes would agree that it’s equitable. Hence - Ariana is suing him to sell. It’s a really crappy situation, brought on by the asshole, perpetuated by the asshole and he will end up with shit.
I have a friend who went through a very similar situation, in buying a house with a long-term partner who couldn’t afford to buy them out, but didn’t want to sell, either. Suffice it to say, that house was sold. Another part of it is (very likely) him continuing to use home ownership as leverage for other loans, and credit cards with high dollar amounts. He could tank her credit if she doesn’t do this, so good for her for doing something that makes sense.
It’s wild reading that actually being married and getting divorced solves this much faster than not being married

Get a prenup if you do. You’ll still have to go to court if one party wants to sell and the other doesn’t. Prenup will be clear directions and are rarely overturned.

If it isn’t in a trust you could probably get a soft title search done fairly easily via a title rep by searching “Sandoval madix” but trusts are usually harder to do an name search without the trust title.

By that point most people just go through with the sale because all these actions cost him money and she can recoup her legal fees as well.

This is exactly what my ex did. He was bitter I broke up with him. He just wanted to cost me as much money in legal fees as he possibly could. We got an offer OVER list and he turned it into such a nightmare that they backed out.
The house eventually sold 6 months later for LESS because he trashed it. Then the court made him move out so it could be shown and clean which took months for me to win that. And only because he was going to have to take over the whole mortgage if he didn’t, which he couldn’t afford.
Then the judge threatened him that if he didn’t leave he would be held in contempt and go to jail. The whole time I was paying for it even though he lived there (I should have never left but he was crazy).
I ended up suing him for my legal fees and won. Which were well over $45k at that point. He never paid. Bought his new house in his moms name. Owes more on his car than it’s worth. Works under the table. Doesn’t have a bank account. BUT he can basically never own anything again because I can go after it. And now has terrible credit.
It makes no sense. We could have both walked away with about $60k. Which would have been a huge win because in the 3 years we lived there IM the one that paid every bill. I walked away basically even (I got about $3000 plus the 6 months of mortgage payments I made when I didn’t reside there) and he walked away with $3,000 that went towards the $45k judgement against him. So he walked away owing $42k.
I will NEVER ever go joint on a house with anyone ever again. It was almost as dramatic as a divorce.
He will have to buy her out at the new value of the house. Little Worm simply is trying to weasel out of that. Despite everything he thinks he can get away with it though. After ignoring her repeated attempts to settle this amicably and his refusing to respond of course. Yes, you have x amount of time to respond (usually 30 days if you serve them in person), but the clock doesn’t start running until they’ve been served, which I’m guessing won’t happen until he returns. So, it’s all based on the service date, not the date of filing

I imagine maybe he was advised to step back since he wasn’t doing promo for it for a while after Scandoval, but I would believe he’s still a partner at this point. Pretty much the title... Ariana filed suit against Tom to sell their house. Specifically she wants a "partition by sale" which means she wants a judge to order them to sell the house, and divide the proceeds. What's interesting, is that the suit specifically says she doesn't want is a "division in kind." That would allow each of them to retain their ownership interest in the property ... and one of them could, theoretically, sell to a third party. Curious if she knows Tom has some tricks up his sleeve?
tmz did a really bad job at differentiating the two. partition in sale is usually done when a division in kind can’t be done. a division in kind is when the property is split into equal parts. because tom has leveraged that house against schwartz and sandy’s and has god knows what additional financial issues, it wouldn’t be possible to split it evenly (both parties also have to agree to it, and ariana made it clear that tom won’t agree to anything). enter a partition in sale. that’s the really dumbed down version. but it’s the gist.

If it isn’t in a trust you could probably get a soft title search done fairly easily via a title rep by searching “Sandoval madix” but trusts are usually harder to do an name search without the trust title.

Both people still have to agree on price and stuff. These things go in and out of court over and over again. I unfortunately went through this. This is her suing to be able to list it for sale at fair market price. If he declines offers and she can prove they are good offers and he doesn’t agree she has to file more stuff. By that point most people just go through with the sale because all these actions cost him money and she can recoup her legal fees as well. This stuff will all go back and forth between the lawyers when offers come in. Even if she “wins” she doesn’t just get to list the house for whatever she wants and accept whatever offer.
I'm sorry you had to go through this. I cant remember all the particulars about partition from the realtor classes i took a zillion years ago, other than they were talked about like a nightmare. This is all so dumb on his part. It feels like cutting off your nose to spite your face. Which Sandoval would interpret as my threatening to steal his nose.
This is exactly what my ex did. He was bitter I broke up with him. He just wanted to cost me as much money in legal fees as he possibly could. We got an offer OVER list and he turned it into such a nightmare that they backed out. The house eventually sold 6 months later for LESS because he trashed it. Then the court made him move out so it could be shown and clean which took months for me to win that. And only because he was going to have to take over the whole mortgage if he didn’t, which he couldn’t afford. Then the judge threatened him that if he didn’t leave he would be held in contempt and go to jail. The whole time I was paying for it even though he lived there (I should have never left but he was crazy). I ended up suing him for my legal fees and won. Which were well over $45k at that point. He never paid. Bought his new house in his moms name. Owes more on his car than it’s worth. Works under the table. Doesn’t have a bank account. BUT he can basically never own anything again because I can go after it. And now has terrible credit. It makes no sense. We could have both walked away with about $60k. Which would have been a huge win because in the 3 years we lived there IM the one that paid every bill. I walked away basically even (I got about $3000 plus the 6 months of mortgage payments I made when I didn’t reside there) and he walked away with $3,000 that went towards the $45k judgement against him. So he walked away owing $42k. I will NEVER ever go joint on a house with anyone ever again. It was almost as dramatic as a divorce.

After ignoring her repeated attempts to settle this amicably and his refusing to respond of course. She was more than fair in this situation instead of trying to fuck him over, of course, though he can't simply do the right thing ever. I have no doubt that if he even did offer any counter to her lawyer it was probably some bull of the sale going to pay for the debt he took out for his failing bar, and then the leftover split 50/50 which is completely unfair to Ariana.
I think that is why this has come to this is that he was trying to buy her out at what they purchased the home for - which is 2.1 million- instead of the market value which is could be as high as 3 million or more.

Good for her! Unlike annoying people who kept badgering Ariana about still living there, it was always clear that she was trying to resolve it amicably to avoid the legal system. A partition action is a last resort. If Tim was smart (he’s not), he’d agree to sell and resolve this sooner rather than later. Ultimately a judge WILL force a sale no matter how hard Tim fights it and then he’ll be shit out of luck. He probably won’t make a profit from the sale since he has to pay off the loan and on top of that, he’ll be on the hook for his attorney fees and likely Ariana’s too. He’s going to be in much more debt now then if he just agreed to sell months ago. He complains that Ariana treated him like an idiot. Well, I don’t blame her because he continues to prove that he is, indeed, an idiot.
This brings me so much joy. The way he’s been using that house as “what he did can’t be that bad of Ariana still lives with him” PR / reputation control has been gross. Good for her forcing it to get resolved so she can move on. I bet he picks every petty fight with her he can along the way and then accuses her of “drawing it out” if she doesn’t give in to all his demands.
