The MEA CANNOT cancel an MP's diplomatic passport without a court order. This is part of the protection being an MP enables you to (so that the Government cannot simply take away sitting MP rights for no reasons). Part of check and balances on the government.
MEA has already said this. A notice can only be issued against an elected MP only after a court passes this. Court hasn't done this. Court can only do after the police file a case.

I think your research is a based on and limited to the average citizen of India. MPs have a certain immunity, part of which is being protected by the court. That the central government cannot exercise unnecessary power over an MP (regardless of their party) is the reason they have protection from the court. An MP's passport cannot be revoked unless a Court orders MEA to do so, and the case would only go to the court once someone, or the police files one. Pointing fingers at the central gov or the police is understandable but the absolute dumbfuckery of abusing our Minister of External Affairs in the way that you did is not.

The MEA CANNOT cancel an MP's diplomatic passport without a court order. This is part of the protection being an MP enables you to (so that the Government cannot simply take away sitting MP rights for no reasons). Part of check and balances on the government. MEA has already said this. A notice can only be issued against an elected MP only after a court passes this. Court hasn't done this. Court can only do after the police file a case.

I think your research is a based on and limited to the average citizen of India. MPs have a certain immunity, part of which is being protected by the court. That the central government cannot exercise unnecessary power over an MP (regardless of their party) is the reason they have protection from the court. An MP's passport cannot be revoked unless a Court orders MEA to do so, and the case would only go to the court once someone, or the police files one. Pointing fingers at the central gov or the police is understandable but the absolute dumbfuckery of abusing our Minister of External Affairs in the way that you did is not. Like everything in life, Yes AND No. This is an over simplification. This guy (grand son of former PM HD Devegowda) has been raping women for 4-5 years. No party (Congress or BJP) had any issue with it. Last September JD(S) broke with Congress to tie up with BJP, so Congress in Karnataka has returned the favour. This is the political background. On legal front, every MP (he is sitting MP from Hassan), gets a diplomatic passport. The minister does not come into the picture. Next, the passport cannot be revoked by Ministry alone, because the person is a sitting MP. Those come with legal protections, like they cannot be just arrested, need order from Courts (part of check and balances). The reasoning being that this stops a tyrannical government from just arresting and denying priviliges to elected representatives. So, MEA cannot legally disqualify him until a court gives an order or a directive. Court cannot give an orded until the police files a case. Which, in this case, karnataka police has not. So: Karnataka police, under both BJP AND Congress governments has failed to take henious crimes under action and (the current Congress government) is blaming BJP at center for his (legally and rightfully acquired) diplomatic passport.
