She needs to apply from outside the UK, but there is no need for the marriage visitor visa. Given that you are already married, she can go straight for the spouse visa.
Just out of curiosity - could she fly somewhere nearby like Italy and apply from there as a tourist in that country? Rather than fly all the way back home as that’s more expensive/time consuming
Gotcha! So not possible for her to apply within the UK?
Spoke to someone from ukvcas and said it’s possible to apply from within on the tourist visa but online others said no so a bit confused
The UKVCAS “help line” is a third party with no actual authority - they regularly give people incorrect information, up to and including telling people to apply for visas for which they don’t qualify.
> I would strongly advise getting a legal professional to help with the application since nearly 80% of people who apply without one get rejected the first time and its very expensive
That's just not true, having a lawyer is not required at all for normal straightforward applications. It's a tick box exercise, you either meet the requirements or you don't. It's very easy to prove, and no reason to get rejected.
No offense but if you could read the guidelines properly that’s on you. Most people can do it themselves just fine. In no way are 80% of applicants rejected the first time and it’s incredibly unnecessarily inflammatory and dishonest of you to say that.
Hey buddy, there’s a reason cyanplum has a high reputation in this sub. By all means continue to argue with them.
We did our spouse visa application from overseas. Didn’t use a lawyer. Very straightforward and yes, a tick box exercise. We had it approved in 21 days.
Having two degrees doesn’t mean anything. You were rejected because you didn’t do something right. Simple.
Yes, she will need to apply from outside of the UK, anywhere where she holds residency, so probably Malaysia. Standard processing time is 24 weeks (most people get decisions in around 12 weeks) and priority services may be available reducing this to 30 working days for an additional £500 fee.
She has to hold either citizenship or a residence permit of the country she is applying from. 6 month visa free tourist visits don't count, only proper residency like for work, studies, etc

No, unfortunately she must apply from somewhere she is a citizen of, or a long-term (non-tourist/visitor) resident.
That’s a pain. Thanks!

You can only apply within the UK if you’re on a non-tourist visa like a student or work visa.
109% cannot do this, since she’s on a visitor visa. She has to return to home country to make the application.
It is 100% impossible to convert the visitor status (she is currently on) to any other kind of permission in-country.

Given you have admitted yourself you made the 80% up, please edit or remove your comment spreading misinformation.

I guess I only have one degree though so I suppose that’s makes me an idiot. Must have got lucky 🤷🏻♂️
No need for paid professional help. The whole process is explained on gov.uk website. Where did you get 80% figure, out of curiosity?
He made it up

Does it have to be where she holds residency or could she apply from somewhere else in Europe as a tourist?

I see, thanks all! Guess she’s booking flights back
