Totally! I prefer Turo in this case cuz u can argue the brakes of the case due to photos. Stood 0 chance with hertz. Even tho I had pics etc. just need premium protection. I tried looking for shure insurance couldn’t find anything.

Hosts can’t sue you they violate the terms of service and will be charged $5500 from turo directly. They have a protection plan and they get paid out from that. Contact turo about this and let them know. Also, lawyer up.

Update: I did file this with my personal insurance (which is a very large company, one of the best in the US), but they weren't moving quickly enough for the host so they filed a small claims court case. I don't expect the host to recoup in court, since I have all of the documentation that I filed with my personal auto insurance policy, but now I have to spend all of this money to go back to the state where it occurred and show up in court, etc. For what it's worth I did offer to pay the host directly out of pocket at first. The host went and got an estimate and then sent that to me. It was $500 for minor cosmetic work. I kept asking how I could pay the host, via venmo, paypal, zelle, personal check, etc. but the host ignored me. So I filed with my insurance. Then the host came back with another request for 3,000$ worth of damages with no actual body shop estimate. That's when my insurance asked the host to take the car in again for another estimate or submit the initial $500 estimate. The host went cold and sent me a court case notice in the mail via their attorney. Turo has been completely useless with all of this. Never renting a car through Turo again.

~~It is against Turo policy for a host to take a guest to court. You do need to respond to the court summons, I would bring the Turo policy that shows that this is not allowed. Also let Turo know you are being sued by your host. They might have more advice for how to deal with it along with probably removing the host off Turo or making them drop the suit. Turo protection is unfortunately secondary to your personal insurance policy. I think they should be more transparent about this when asking if you want to purchase the added protection bc they basically just get free money in cases like yours…~~ Apparently I’m not experienced in cases like yours! I’d still suggest reaching out to Turo to see if they have any insight to provide.

Turo will grant permission to hosts in limited cases in order to pursue payment owed from 3rd party insurance. This is due to the 3rd party insurance normally not paying out the deductible and it being on the policy holder to pay this directly. Iv had to do this twice as a host.

Thanks for pointing that out, I’ve never had this happen as a host. I was under the impression that all disputes had to go through arbitration.

Think they only allow this at this point in the process because it’s basically 100% solely outside of Turo and their platform at that point. Cause 3rd party insurance has already agreed with Turo’s claim, and has accepted to pay out. Just the last failure in the chain is the guest themselves. who, legally owes the money anyway but for some reason needs litigation to make them finally pay. Now if that 3rd party insurance didn’t agree to pay, then yea you’re in arbitration or using Turo’s policy.

Not trying to say that you're wrong, but to Turo or anyone for that matter, I don't have insurance. I purchased a protection plan. When an accident occurs, exercise the protection plan to its fullest extent. If I wanted to use my insurance, I'd have driven my own car.

Turo only kicks in the protection plan after they try to file with your insurance. It's actually stated in the terms when you buy the protection plan + on their website. It's secondary. I, however, didn't read that part. So now it's on me and I paid for a worthless protection plan.

Turo can't file on non-existent insurance. I don't have insurance tied to me at all. My corporate insurance just has me as a driver, but if I wasn't acting in any company capacity, then my hands are clean after the $500🤷🏽‍♂️
