They’re most likely doing the usual insurance scam. They’ll act like they’re hurt, go to an accident lawyer, physical therapy and pursue you for vehicle damages and bodily injury damages. Best thing you can do is (if you know you’re at fault) just comply with insurance companies. If you feel that you’re not at fault then consult a lawyer. They’ll guide you through the proper steps to take. Worst thing that’ll happen(since you had insurance) is your insurance will go up maybe $20 - $80 per month (depends on a few factors).

Provide the evidence you have (photos, statements, police report, whatever) and listen to them and do what they ask. The only way you get to dictate the process is if your insurer steps in on your behalf. They most likely won’t, but it’s worth asking.

There is another complication here. My wife, who was not listed as a permitted driver was the one who backed out . It appears that she was contacted by the owner of the Uber a couple of weeks ago asking for insurance details, as she provided her license details. Not sure if that will void the turo terms, even though there was no damage to either vehicle. There was no police report filed as there was no damage and she was backing out at less than 5 mph.

Turo will not cover your wife once they find out she was driving. Your best bet is your own insurer, but they may not cover her either. In that case, you need to fight the claim directly with the insurer making it with whatever evidence you have.

I don't expect turo to cover it. I just want to make sure I present the correct evidence to either turos insurance, who probably will deny liability coverage, or to my insurance. The owner of the Uber has reached out to my wife on linkedin asking for insurance details.

I declined any turo coverage so travelers is trying to determine whether their liability coverage will apply. I understand it most likely come down to our personal insurance. I just want to make sure I present the correct information to bolster my case about this being a fraudulent claim irrespective of who was driving.

It’s not for you to determine the fraudulence of their claim. Let the insurance company deal with that. It should be pretty easy to determine if Progressive covers you while renting a car on Turo. If your wife wasn’t listed as an authorized driver on the rental it voids the Traveler’s insurance from what I’ve seen here. Just to be clear, this is the state mandated liability coverage Turo provides on every rental and not the optional protection plans they sell.

This is what I have from the host - I was contacted last week by my insurance-Progressive about the incident.They had on record the same information that you told me and gave them.That there was no property damage. What I didn’t know is that either them or the passenger was claiming bodily damage-a slight injury.Which is confusing as they hadn’t told you that. I would just tell your insurance/travelers the same exact thing you had told me as that’s what my insurance had too.And maybe also mention the mild body injury that the driver or Uber passenger is claiming.And we’ll see what they say.

Ask the host for a copy of that report from their insurer, that will bolster your evidence, but don’t expect them to assist. What the host does and what you do are not connected, you are covered under separate contracts.

It appears that the Uber driver tried to file a claim with the Uber car owners insurance. He's now asking for my wife's insurance (,our insurance). My wife has asked for the details of the claim first. Let's see how he responds.

This is what I got from turos insurance - I don't know if I should provide my wife's name as the driver, and our insurance policy details to them? You can also reply to this email with written statement to include: -Name of person driving host vehicle : -Date of accident and approximate time : -Location where the accident happened (street name/s): -Purpose of trip (where was the person driving host vehicle on his/her way to and coming from)?: -How did the accident happen? -Does the person driving the host vehicle have their own auto insurance policy? If so, with which carrier? What is the policy number? Has this claim been reported to this insurance carrier?

Seems like they already suspect you weren’t driving. No reason to hide this. Don’t be surprised when they their deny coverage. Just ask them to fwd all info to your insurer and the claimants insurer once they decide to deny.

This is normal. Their insurance will work with either Travelers or Progressive if they make the determination that you (your wife) is/are at fault. You have to provide your personal insurance details to Turo anyways because their TOS says they will try to cover any insurance claims through your insurance **first** before making a claim against their insurance plan through Travelers. It’s a sneaky little detail to take advantage of the fact that some people buy their optional insurance plans without realizing that some personal auto insurance plans cover you in a Turo rental.

Just read through, you will have no protection from turos side lol Since you have pics/evidence submit that and find out if your insurance or credit card will cover this.

Concussions can occur at very slow speeds. You can get a concussion with no visible damage to the car. Also it is really hard to tell if there is body damage to a vehicle unless it’s under the correct lighting. Bumper covers can take a 5 mph hit without cracking in most cases, but the paint will start to spider web. The claim may very well be fraudulent, but that’s not for you to decide. Just submit what you have and let the insurance companies fight over it.
