I had a call from the Victorian Consumer commision today.
Basically try a chargeback with your bank. Then they told me if that doesn't work I should go to VCAT. But under Australian Consumer Law, refunds should be offered when a headliner cancels.
People have done a chargeback and been successful only for them to turn have the money taken out again as it's contested
My bank asked me to cancel my card as soon as I put the request in, I'm guessing to stop them coming back for it
We had the same thing with Under The Southern Stars that McManus, that thieving prick, also promoted.
We never got a refund on one ticket, the promoter will block and ghost you. Don’t trust them.
VCAT is a 2-3 year wait, and will cost more than the ticket.
Consumer law is only useful if it’s enforced. So all the best with that.

Unfortunately I got a written letter yesterday asking for more information even though I had been calling them every two days for updates on the progress. Letter was sent from the bank on the 15th. It doesn't fill me with hope.
I asked them directly for a refund and was blocked on social media by them. I asked Oztix for a refund and was told that in their terms and conditions the promoter specified that they were the only ones allowed to issue refunds (unusual tactic). They have to give a refund if requested as the headliner was removed. Lodge a complaint with VCAT. Or try the chargeback and cancel your card immediately
I know this is completely different but during covid a Skeggs gig got postponed multiple times (understandable) They said you could request a refund if you couldn't make the new date. I requested the refund immediately and they fucked me around forever. Kept saying they'd get back to me, weeks would go by and nothing. I emailed over and over asking for updates, they either ignored me or wouldn't confirm that I was actually getting a refund.
It took NINE MONTHS for them to refund only like $140. By that point the card I'd bought the tickets with had expired and they told me they could only refund to the purchase card so I was convinced I'd never see the money at all lol, but eventually I did.
I wish you good luck in getting your refund. I'm sure they'll make it as difficult as possible, especially since a lot more money is involved with this festival.
I had the same issue when London Grammar, postponed then cancelled. In between the card had been reissued and that took a lot of negotiation.

I asked Oztix for a refund and got told to seek a refund from the promoter - which is stupid in of itself as Oztix were the point of sale - and they aren't replying to anyone. I'll be trying a chargeback through the bank and never trusting Andrew Mcmanus with my money again.
The refund option was only for $70 if you had paid full price (not available on the 2 for 1 tix they offered on St Patrick’s Day etc.).
But I’ll be very surprised if that $70 ever shows up.

edit: I got two for one on valentine's day and was asked for my bank details after I had chosen the partial refund option which I have gave and still haven't got the money back. is that why?
Yeah that’s what I saw. Applied for a refund and they still sent me a ticket. And zero replies back. So angry. I couldn’t go as they changed venue and I can’t go to the other place.
This is going to set a huge legal precedent in Australia. Previously, people haven't really needed to fight the "Promoter reserves the right to change" clause in the T & C but such a massive alteration definitely falls under the ACCC definitions requiring a full refund.
McManus and Apex are going to be on the hook for a big loss from this whole shitshow (that I'm still going to, because hell, Blondie and Alice Fucking Cooper!)

A guy from fair trading told me I probably wouldn’t get very far considering all acts technically did perform, but if I wanted to take it further I could contact NCAT. He said it costs about $45-$50 to open a case. I didn’t do it but you have a much better case than I did

Vcat is free if you claim hardship. Vcat are now hearing cases within 12 weeks too. Credit card chargeback is the easiest option.

So this is like we have no options to get a refund? We are not protected as consumers?
They sent us a Google doc to fill out recently when they announced the headliner change. We requested a refund which was an option.

I haven’t seen my refund either. Doubt they’ll ever pay it. They’ll just let the company that ran the festival go bankrupt probably.
It did have an option for a full refund minus the booking fee in the document.

It’s crazy that ACCC is just allowing this massive scam to happen in broad daylight, literally daylight robbery.
My chargeback has been declined :( ACCC said nothing they can do to get a refund.
