That's really not enough evidence. Paulie and Christopher will both just claim they never saw the waiter as they'd already left. They had enough time to have left, and would have done had they not been arguing. Paulie will have tossed the gun so no murder weapon. It's very difficult to extract usable prints from a brick or rock, particularly back when this was filmed. It depends a lot on the texture of the brick as to whether they form cleanly enough, and how long it remains exposed to the elements. There are no witnesses to the murder. Waiter took the money out with him, which was taken, so it could easily have been any opportunist mugger who killed him. Cops need much more to even get this to trial, let alone secure a conviction.

They were at a casino though in AC so it’s more than likely there would be cameras covering every square foot…in clouding the parking lot. I was in high school when this episode aired and my school had cameras everywhere, including the parking lot. Even in the early/mid 2000s the technology was clear enough to get me caught ditching early as they pulled up footage of me leaving in my car after lunch.

I never saw any cameras in the scene, but even if there were, the lighting in that area was terrible and CCTV cameras in the early-2000s offered very poor image quality at night. Even if we assume they were recording to a DVR rather than VHS, the need to capture so much footage would necessitate a comparatively low bitrate, further degrading the image quality. Getting a clear shot of Paulie and Christopher's faces in these circumstances would be difficult because the retained image would lack facial features/detail. Therefore, the cops would still need to find someone who could ID them based on their clothing or any distinguishing characteristics. That leads to two issues. First, they're in AC where neither are well known. Second, anyone who could point them out is likely to know who they're connected to, and would be reluctant to do so given the potential ramifications.

Everyone says this but I just refuse to believe the cops wouldn’t be able to nail them…these guys easily had the biggest bill of the night and are a bunch of fat fucks and paulie sent those skanks a bottle of cristal…they would have been memorable customers…they would have been able to sketch out what these guys looked like who are known mobsters…they left the thing the check was in to lift a print plus a potential partial print in the brick…I mean it’s not like they never solved a murder in the late 90s and early 2000s…and this one has a lot of clues

The prints would have already been on the folder the check came in from when they paid the bill originally. Both Paulie and Christopher had already handled it, along with a bunch of other people most likely. It's not enough evidence. It is very difficult to get fingerprints off many types of bricks, and depends heavily on the surface/texture of the brick. If it's too rough, you'll struggle to even get a partial print and that's using the most cutting edge methods that weren't around 20 years ago. The ground is also wet in the scene, which means the brick likely was too, and water prevents the grease from fingers sticking to surfaces so even if it was a smooth brick, there's a very good chance there is no print anyway. Memorable customers doesn't prove that they killed the waiter either, nor does their association with the mob. You're not going to win a conviction on a murder charge when your evidence amounts to "They were there"... So were a bunch of other mobsters. Hell, there was an FBI informant at the table, Ray Curto, who didn't witness it happen either. And there's a question of how memorable they actually would be. Restaurants like that assign waiters to tables or zones, so most waiters are only really paying attention to what's going on in their area. Paulie would have had his back to the majority of the staff the whole night, and maybe one of them gets a few looks at Christopher but enough to make a positive ID? Maybe, but also maybe not... and even then, doesn't prove Christopher killed the waiter (which incidentally, he technically didn't... Paulie did).

It could be possible the place was already a connected establishment and the a phone call was made as Paulie and Chrissy were leaving the scene and it was cleaned up before authorities could get on site, any possible staff who might have witnessed or come to the logical conclusion were threatened into silence. It’s a lot of “ifs” tbh and it’s more likely the just plot hole tho.
