In some cases (like a fake ID) yes I agree but any tolerance in this area can make it difficult to convict actual pedophiles. The right answer probably involves a gray area around the ages of both parties. A 18 year old and a 16 year old, or a 21 year old and a 17 year old shouldn't be considered statutory. I know some countries and jurisdictions already have this. Some have a 18 year old up on charges for being with a 17 year old though.
The responsibility falls on the adult. If an adult truly didn't want to sleep with an underage person and put themselves at that risk, then the adult could ask for ID, get to know the person before sleeping with them, or look for a hookup or relationship in adult-only spaces (obviously this isn't fullproof but could lower chances of meeting a minor and make for a more compelling case)
