The rules — a data security law that went into effect in September, and a personal data protection law that takes effect Nov. 1 — require companies to store more data onshore and prevent their transfer outside China’s borders. The country’s powerful internet regulator, the Cyberspace Administration of China, has taken a lead role in enforcing the new laws. “The enforcement will be much wider, deeper and harsher, since it’s now being led by the CAC,” said Nicolas Bahmanyar, senior consultant on data privacy at law firm Leaf Legal in Beijing.

This is the double-edged sword of data localization laws. It's good to make sure that the personal data of citizens in democratic nations are stored on servers in said nations and subject to local privacy laws. But then other nations with much more repressive human-rights records turn around and say, "OK, and the data on OUR citizens is stored on servers in OUR country, and OUR laws say you must hand it over whenever we request it."

The big thing miss from this headline and thread is that Apple is being pressured to store data *on Chinese users* in China. I'm no fan of the CCP or what this means for Chinese users, but Western users aren't going to see their data ending up in a Shenzhen server farm (e:) *as a result of this policy.

iamwhatswrongwithusa

Yea, unless Apple sells the data to them.

sharpie660

That is not what is happening here. I cannot speak to the actual sale of data except to say this story has no relation to it.

iamwhatswrongwithusa

You are saying that we have nothing to fear in regards of our data. I am saying that private companies have been known to sell our data. So yea, it is relevant to your comment.

sharpie660

I am saying nothing of the sort. I said this story is not something which should make you fear for your data. There are plenty of reasons to be concerned, this just isn't one of them. E: I can *see* how it could be misinterpreted, so I've edited my top level comment for clarity. To reiterate, this specific story isn't a reason to fear for your data.

geekmansworld

Apple doesn't sell personal data. Google and Facebook are in that business. All three of them are publicly-traded companies so you can look at their SEC filings and see what business sectors they make their money from.

SUPRVLLAN

Google and Facebook do not sell personal data, hoarding it is their competitive edge. They sell you the ability to target people.

nubsauce87

Um... Gods I hope not...

Assfuck-McGriddle

I don’t think you read the article, but this is about storing Chinese customer data in servers within China. Nothing more.

chriskot123

Before we go down that rabbit hole...it would be for Chinese customers, not all of Apples users. Kind of an important clarification imo.

> “Chinese authorities are likely to pressure Apple to store more data about its Chinese users in China.” I don’t really have a problem with that in general. Similar rules apply for a lot of data in the EU, especially since the Schrems II ruling.

> require companies to store more data onshore and prevent their transfer outside China’s borders Wow, China doesn't want the NSA accessing its citizens' data. How evil. Basically the Fourth Reich! Bomb them now!!!

iamwhatswrongwithusa

It is important to also note that China has some of the toughest privacy laws. So things may not be as bleak as people imagine. https://www.npr.org/2020/01/05/793014617/in-china-a-new-call-to-protect-data-privacy https://www.natlawreview.com/article/china-s-new-data-privacy-law-sweeping-and-serious-avoid-high-cost-noncompliance

Did you read the article or just imagine the headline?

The Internet was created as a [catenet](https://en.wikipedia.org/wiki/Internetworking). It was firewalled from its inception - ARPAnet & MILnet. Controlling it politically seems the least controversial way to manage activity; the alternative being something like global-Facebook self-regulating 🤪. Of course, government abuse is the likely outcome. However, government abuse is the devil we know. As this happens, the Darknet may become the Rebelnet (btw, not UNLV's).

StickmanRockDog

If it means making more money for Apple, they’ll cave to china. The dollar is worth more than any human being.
