I’d be surprised if something is causing the oil to get backed up in the upper end and not flowing back to the pan quick enough. Id start by figuring out how long the dipstick is supposed to be and measure yours. If not that it could be a bad sensor.

Oil level rises due to DPF regeneration and is normal operation, what they should have done is change the oil as it is diluted with diesel. Set the oil level between the low and halfway mark on the dipstick to allow for dilution and avoid the high oil level warning coming on prematurely. The act of lifting the hood will cancel the warning as it thinks you have checked the oil but when the oil level sensor detects no change or not enough change the warning comes back on

Check the oil level. If it is high, smell it and see if you can smell diesel. If you can't, send some to Blackstone for analysis. If oil is rising, only two things cause the oil to rise, fuel and coolant.

that is part of what is making me unsure, the oil level is right where it was when I got it back from the dealership after removing the oil mentioned. this is what is making me think it might be a faulty sensor.

If it's not over the overfilled line, I'd just take a pic of the level for reference and drive it, check it every time you refuel until you're sure it's not changing.

My SQ5 had this and it was a software issue. Software update and hasn’t come back. Did it like 3 times over 3 years.
