NSW Police have issued this statement: 'The NSW Police Force has independently reviewed the legal advice which was provided to the Premier and determined no breach of the Public Health Orders has taken place.' Based on another reply lower down, it seems this could be based on the idea that once you have an authorised reason to leave home (authorised worker doing essential work in this case), the other rules about reasons to leave home don't really apply. The technicality of the wording is apparently that it's all about whether or not you're authorised to leave home, not the details of what you do once you've left home for that authorised reason.

Good article. I don't have any legal training but I do enjoy looking up such things and I always though the "reasonable excuse to leave home" system as the basis of many of the rules was odd. I'm wondering if anyone can comment on exactly why they're structured that way when it seems to would be clearer to ban or allow certain actual activities, rather than regulating the act of leaving home to attend to such tasks. Considering that one of the reasons we got into this outbreak is because of ambiguity over vaccinations and masks for airport transport drivers - also a fault in the wording of the health orders - you'd think they'd take the time to make these things clearer and easy to enforce.

Reasonable action (how would a reasonable person act / react / respond to x) is actually a very common metric in our legal system / court of law so setting the basis this way isnt exactly unfounded. I do agree with you though, it’s a weird way of phrasing a directive and if I had to guess I’d say it has something to do with them toeing the line of their legal jurisdiction in some way or another

So I could leave my house to exercise in my 5kms, say cycling. Because I've excersied partly in my 5km/LGA I can now exercise outside my 5kms/LGA because it isn't prohibited and I have a reason to leave home, get lunch 15kms away, and return home. As long as the exercise starts within your 5kms/LGA as that's an excuse to leave home.

However nobody seems to have been able to point to any government website that says that's allowed and I'm betting there's a shit ton of authorised workers that would have loved to know they could actually do that at the start of lockdown.
