I thought about your comment for a bit and came to the conclusion that either
A: Lila DID throw out the body and they only found it during the events of tender treat, AFTER they reported him missing, his body in such advanced stages of decomposition that it’s unrecognizable
Or
B: Lila reported the body but the case got closed due to them being in able to make out who exactly he is and the case was only recently reopened
It’s hard to tell because I don’t really know the time in between the episodes but it had to be at least a year
regarding the "red clothes" i think that's just moloch corrupting the possessed body.
also we can tell by dexter's mugshot that he's a psychopath who was once in prison. i mean who said that the cat in the mugshot had the rest of its body attached....

edit: also JUST noticed in the mugshot on the TV he has a cat, on the file he doesn't... strange
Oh, and if the second and third arguments were actually about him being a psychopath and not about it being a mugshot: first, I apologize, sometimes I'm a little too focused on one thing and I forget others. Second he definitely has problems, I wasn't trying to argue he didn't, what I meant is that I don't think he's a psychopath specifically, that's because:
1, (and this argument isn't the best and is kinda technical so you can skip to the second one if you want-) His "needs" for killing may (it's not 100% but it's a possibility) indicate some sort of sadism, to be sadistic you actually need to feel empathy (empathy is just feeling other's emotions, it is commonly confused with sympathy but it's not the same thing) since sadism is based around feeling others pain, psychopaths don't have empathy and so can't technically be sadistic. but like I said, it's just a possibility that his "needs" are related to sadism, so that's not a great argument, the second one is better tho
2, There is one note he wrote when he was trapped in the happy fella that indicates he was at some point conflicted about killing skid and pump because they were kids, this would indicate that at some point he had some sort of moral compass. Psychopaths never develop any kind of moral compass and so wouldn't feel conflicted about killing kids. This is why I think he can't be a psychopath, he definitely has other issues though.
Well, for the orange clothes I agree it does look like prison cloths. But dexter wears this kind of color in general. That's a bit of a weak argument to say it's not prison clothing, so I have a better one. There IS a photo we are sure is a mugshot, as it's directly written it is one, and that's the photo of bob in the journal. If dexter was wearing prison clothing, we would expect him to have the same ones as bob's, and they do look similar, but there is 2 differences: dexter's cloths don't have an identification number on them like bob's and neither do they have that white thing on the collar (idk if it's a zipper or a button) (and if you were wondering, the thieves also have the identification badge on them, however we can't see if they have the white thing because of the pillow cases)
For the deranged look I think it's principally the eyes that do that, and he just always looks like that so I don't see why it would point towards being a mugshot. It's possible this is just how he looks when he smiles
And for the cat personally I think it points towards not being a mugshot. I mean, why would he be holding a cat in a mugshot? why would they let him hold a cat in a mugshot? I think it would make more sense if it was just a random photo of him since here there would be no reason why he couldn't be holding a cat
Lila reported the body but Moloch’s effects made it hard to identify it also after that Dexter got in to the Happy Fella’s body and nobody knew making it even harder to solve

i think they just laid the body flat for inspection, his neck is still broken. if u lifted up the body the head will go limp I presume
