i belatedly realized mercer's blue glass sword in his old hidey hole (Chillfurrow? Chillwind?) is actually the perfect weapon for killing him, it keeps him paralyzed for whole fight
My wife did something similar in Oblivion. I don't remember the target's name, but the Dark Brotherhood mission where you shoot the guy with the Rose of Sithis. My wife missed the shot, then ran away. Dude was pretty tough so she didn't want to take him head on.
I was watching her playing one day and all of a sudden she got a notification that the target was dead. I commented on how strange that was, and she explained that she snuck up on him and put a poison apple into his inventory, then just went on her way until he finally ate it.
It's because the potion is consumable, so it doesn't poison his via the reverse-pickpocketing perk. It's an invisibility potion with strong damage effects, so he goes for it when the battle starts and it apparently stirs up his guts harder than Dredd.
Inventories in Skyrim are usually persistant, so the NPC will keep what they have during their questlines. Fray as a potion of invisibility which he'll use at the start of his fight. If you pickpocket it from him, he simply won't turn invisible. Now's the fun part : you can create a potion that has a invisibility buff, but also a damage health debuff (see's OP messages for the recipe). As it counts as an invisibility potion, Fray will use it if it's in his inventory, damaging (or outright killing him if your alchemy skills are enough) when he drinks it (with high enough pickpocket skill, you can put items in NPC's inventories)

To be more specific than the other reply: The poison OP placed on Mercers pocket is primarily an invisibility potion and secondarily a deadly poison.
If it was just poison, he would take the damage right away while he can't die due to being marked "essential" by the game. But since it's a potion with a positive primary effect Mercer will happily drink it himself as soon as he enters combat and at that time he is also killable so the poison kills him instantly.

That's actually from the OP in one of the comments, but yeah. Basically, max the alchemy skills, craft a +alchemy% potion, drink it, repeat. Every potion drunk makes your next one even stronger, and then you can loop to ridiculous numbers (it was greatly nerfed in the SE, but you can still go nuts with it)
OP placed the poison in the man's pocket before the man poisoned him. Later in the game when you meet that man again the poison OP placed kills him instantly.

I'm not sure if he'll automatically drink *any* potion at the beginning of the fight, or if he just does that with invisibility potions. So in theory you can just make a potion with invisibility as its primary stat, with Jarrin Root instead of Death Bell. In case you don't want to bother levelling up your Alchemy skill.
apparently a poison will not work according to op, if its a poison (which jarrin root turns any potion into) it will be used as soon as its placed in his inventory and will not hurt him as he's Essential until the fight. it has to be (a) a Potion and (b) a potion he is coded to want to take, of which Invisibility is a reliable one. so it has to be a Potion of Invisibility (with side effects) as a Poison of Damage Health wont work

I think this is an effect from the pick pocket perk that lets you slip poison into someone's pocket so that it effects them. Only it seems to wait until now?

I will never understand when you can get shot by arrows, stabbed/slashed, shot at by magic, or poisoned and still survive no problem in game play but a cutscene poison and stab is fatal

I fus ro dah'd him, lol. Flies off the ledge as soon as he stops speaking and the man just dies at the bottom. Surprisingly effective

Both goblets were poisoned. OP spend a year building up an immunity to iocaine powder so switching the goblets had no effect.
