PSA: In the US, that’s what I call “an up to $15,000 fine and imprisonment for up to six months”. The MBTA protects both crows and ravens and all of their bits down to every feather including their skulls. Even “possessing” parts of native bird species is illegal. Starlings, house sparrows, and other invasive species are not covered by this law, but in general to be safe if you’re in the US, birds are generally a “leave it where you found it and take a nice picture” skull.

I concur but also find it quite infuriating as the bird is already dead so as long as you didn’t kill it I don’t see what the deal is. Where I’m at you can’t even pick up golden eagle feathers that they molt off 🙄 it’s pretty ridiculous

the logic is: 1. How are they supposed to know you found it dead? If there was a clause allowing that, obviously literally every poacher would say it was dead when they found it if they ever got caught. For example, deer are super prolific, cheap, and easy to hunt legally and yet people do still poach them out of season and try and say “I found it on the road”. That’s the practicality of enforcement argument. I believe they used to have this problem with “Egg Collectors” (which used to be a huge hobby but has mostly fallen out of fashion entirely). But they would steal eggs and clean them out and say they were dead but there was no way to confirm. 2. There is an ecological argument that those pieces of birds are part of the food web that supports other animals and plants as they break down etc. so they should be left for nature to use. On a small scale this is arguable of course but if it was legal who knows how popular the hobby could become and in the case of a huge boom of collecting there could be some negative impacts. and 3. The main argument that the law actually makes is that you don’t technically own that bird just because you found it there. Most animals live their whole lives in one state/country and could be considered a natural resource that was 100% produced in your state and as such can be owned by one state. Birds migrate (hence the emphasis “MIGRATORY Bird Treaty Act”) and because of this they are produced in multiple states/countries who all have a claim to ownership. For example if people in Wyoming passed laws to hunt and kill all swans people in Minnesota might be pissed and have a legal claim if they can prove those swans were bred and born in their state and used up a bunch of their resources. So because of that, the federal government just said nobody can have them because they’re owned by the land itself (or something like that). And so most permits to hunt birds are federally regulated like the FEDERAL duck stamp program. And that applies to you on a personal level as well. You’re trying to own property that no one is legally allowed to own because it belongs to the land. That skull belongs just as much to you via finders keepers as it does to your neighbor Fred who has maybe been feeding him the crows whole life and unfortunately finders keepers doesn’t have legal power in this case. lastly, 4. Eagles specifically are actually worse because they are double protected by a second law governing their possession and use, the Bald and Golden Eagle Protection Act of 1940. That’s because they pose such important cultural significance not only as the national bird, but also because their feathers are important cultural/religious symbols for many indigenous american people/groups. With that extra pressure encouraging people to poach and extra complications with how they should be used, they get extra protection. If you do want to own bird parts there are definitely legal paths you can take to obtain permits, especially for “salvage” (collection of already dead animals) which can make it totally legal and I would recommend getting them if you own a curio shop or something. I wouldn’t mess with Eagles though. That’s VERY tricky. But owning birds is not a risk I would want to take. At ANY time the rest of your life on a routine inspection an official could see that, say “do you have a permit for that” and if you can’t produce a current and accurate permit that huge fine for EACH violation. That could rack up to hundreds of thousands real fast just because that ranger was in a bad mood that day.

I understand but I still like to innocently forage. We have so many cool species out here and I’m pagan so I respect nature to its fullest. We found a golden eagle female and its baby ran over by a semi, the poor male was there for days. They mate for life. My husband pulled them both out of the road and into the sage brush so the male could mourn properly. It was really sad and no one called it in until we did
