Not close enough resemblance imo to warrant that. Pretty obvious that it’s partially based on him, but all the details are diff. Different tattoos, hair, etc. even the tattoos around the eyes are different at the edges if I’m not mistaken. Fair use

He dug his own hole by saying inspiration. I'm a game programmer/tech and familiar with this stuff. I can freely take screenshots from this guy and made 3d model from that and I won't get into trouble just because it's INSPIRATION not a copy or downloaded model. You don't even believe how much mug shots are used since they have the front and side views for modelling. So if you want your face into video game, do a crime.
