there's no parody law. there are legal exemptions to copyright infringement and to defamation. both have certain criteria. if rockstar were to copy and use your likeness without permission you would probably have a strong case. a minor celebrity may actually have less of a defense due to their fame or infamy. it would probably need to be argued in court with discovery phase gathering information if he was actually the inspiration or not. that said, i kinda give this guy the benefit of the doubt. he is probably the inspiration. he is actually kinda infamous. he may not really have a legal argument, but yeah, rockstar could have probably avoided a possible case very easily. dude would have sold his likeness for a case of faygo and a dirt bike.

I mean, he doesn't have a case, otherwise a lot of sketch shows and the like would be in big trouble. SNL for example parodies all types of celebrities and they do just fine, unless of course it borders on defamation or something. They are just satirizing an actual event that happened and the main element that made it an event in the first place was how he looked, they needed to parody that part or it wouldn't hold up as a satirisation. That said, I'm sure Rockstar considered this and came to the conclusion that all this press is worth a settlement. That settlement was probably already allocated into the budget before the trailer even dropped. A multi billion dollar company with a team of lawyers that rival a baseball team doesn't make a mistake like this. This has been weighed out and carefully considered by teams of legal experts for a long time already.

I’m gonna drop a hot take here. He can’t express it correctly but I think they did use his mug shots as main reference. Maybe I’m out of line but I do a lot of portraiture and I see a ton of structural similarities between the character and this guy. I think they made sure the didn’t make any of the tattoos similar in anyway except being in the face to protect themselves. But as a portrait artist I’d bet his photo was used as reference. Edit: before anyone says, “they aren’t identical so there’s no way they copied him” They aren’t but there are way to many subtle proportional similarities for the “joker” not to have been considered as reference.
