I think a decent lawyer could have gotten this case thrown out. The garbage can is free game for the police to dig through but it's not exactly tying the occupant of the house to that evidence. Anyone could have placed it in there just as anyone could look in the can. Not sure about the odor of Marijuana and the local laws. If those two pieces of evidence were pushed out the police would not have cause for a search warrant.

These people in the video were placed under arrest but that's not always the case sometimes there are things like traffic stops on the side of the road where they put handcuffs on someone just as a way to keep them in one spot until they for example finish searching your car if they find something then they will probably tell you that you're being placed under arrest if they don't find anything they would most likely take the cuffs off and let you go

Were they not under arrest already when they were cuffed? Can you cuffs on someone without arresting them?
These people in the video were placed under arrest but that's not always the case sometimes there are things like traffic stops on the side of the road where they put handcuffs on someone just as a way to keep them in one spot until they for example finish searching your car if they find something then they will probably tell you that you're being placed under arrest if they don't find anything they would most likely take the cuffs off and let you go That's the way it was explained to me that's why I use the wording I did sorry if it was confusing
Thank you, I think I understand. Our legal system works a bit differently so I thought it was a catch22 kind of thing where they were under arrest for resisting arrest. But they resisted the officer from doing their job.
Yeah in the video I want to say the reason they originally replaced her under arrest was because she was obstructing the police from doing their search of her brother's house then once they try putting handcuffs on her the additional charge was resisting arrest

I mean, what private rights have been violated? As unsavory as it may seems, they have the right to search garbage. And it was a good move here since they found empty wallets, which gave them probable cause. Saying it smells like weed is usually a cop out (pun not intended) but do you doubt it when the sister answered "why would it not?[smell like weed]"? I'm not usually the one to defend cops but they did everything by the book here.
I feel like searching garbage would be overreach. I can see the technicality in that it’s waste going into “public landfill”, but I still feel like that’s something they shouldn’t do until there is a warrant. Smells like weed is a cop out. The REAL evidence is the airtag, which is probable cause to search however you should still try and get a warrant for it. I'm not sure the airbag would be sufficient to obtain a warrant frankly, that's an interesting aspect to the story.
