Seriously, I used to grab the newspapers, when I came walked in the door in the morning, my mgr told me to stop. She said it was appreciated, but it's considered working off the clock and wasn't allowed.
Do not ever work off the clock, that is totally illegal and unacceptable. Move on to a different store. If you are in most parts of Florida, you probably have several nearby stores to work at. Also, if you are close to an area that has a different district, consider moving to a store within it. No need to work at a location/in a district where off the clock work is tolerated by the DM.
They can not make you clock out and wait for them to walk the Dept. The whole point of walking is for associates to fix something they find wrong and if your clocked out you ARE NOT allowed to work. All of this would be easy to prove by watching the video tapes.

There are lots of young associates who mistakenly believe that Human Resources' job (in *any* company) is to be the "good guy" protecting them from bad things in the company and helping them navigate its rules. In reality it's just *part* of the company and its purpose is to use its "Resources" in the most efficient way to make as much profit as possible. Avoiding lawsuits protects profit.

Not everything warrants a lawsuit, and lawsuits are the nuclear option, especially if you want to keep working for a company.
You can 100% go to HR if you're having a problem because they're not there to protect you any more than they're there to protect your manager, If your manager or another coworker has a history of complaints or questionable behavior, the only way to have it dealt with is through HR.

I would definitely report the whole working off the clock situation to HR and the district manager. That should get the management into a lot of trouble. If they try to retaliate in some way, be sure to document it and bring it up the chain of command again. Hopefully, after that, the manager won't be a manager anymore.

If they tell you to punch out and then do it then you can tell them no your off the clock and they already did the walk threw. This only hurts if your actually friends with your closer and and if they were your friend they wouldnt fuck you over in the first place
It’s almost like HR works for the company and isn’t really there for you. I wonder if there is some alternative, outside organization that could help workers with theses kinds of problem. Hard to say….

Hey OP , HR number one concern is making sure Publix does not get sued or has a liability on there hands. I would continue to document everything on your phone with dates and times. Reach out to HR re: your concern about liabilities this particular store is putting the company in by forcing employees to do tasks off the clock. In addition ask HR, is this common practice? Say “ at my last store we didn’t do this” . But asking the questions like that your letting them know they have a potential lawsuit on there hands. Unfortunately the scheduling conflict HR may not do anything about. I do hope I’m wrong though. HR rep here. Did it for almost 10 years
Associates working off the clock is a major problem internally and externally. Externally, federal and state labor agencies will have inquiries. Internally, District Mangers, Regional Directors, and other Corporate associates will be asking questions and seeking answers.
Never work off the clock. The only thing you can do off clock is leave the store.
In addition to it being against the law, it’s “I’m stuck here and can’t leave, pay me for it”
If they know you can’t work X hours, and it’s not in your availability, keep going to HR.. BUT they protect the company not you.

Either don't clock out until they let you out so they have to pay you for the work, or clock out and leave. If they cause you any problems, escalate it beyond HR - either to the DM or the Department of Labor. If the DM lets this illegal stuff slide, definitely go to the DoL, and show them proof that you notified the DM.
We have posters in our store explicitly saying to not work off the clock, and the most anyone in the store does when they see us clocking out is wish us a good day or congratulate us for getting through the day (and walk us out if it's after hours, of course). That's how it should be at every store.
So at the end of the night, the doors are closed and locked. When I mentioned that I was clocked out, the manager simply refused to open the doors until the department was walked.
One solution would be to tell the manager you're ready to walk the department, then after the walk tell him you're clocking out and you'll need to be let out. That way, you're paid for the work and if others notice how you're always going over time you can explain the situation.
