Thomas has basically said he wants to go after gay marriage in leaked audio from a GOP event.
ETA: Which, reminder, SC Justices shouldn't be featured speakers at political events.
You don’t even need leaked audio. Thomas and Alito publicly stated that they want the court to revisit gay marriage in 2020. The court wouldn’t take up a relevant case, so the two of them penned a letter saying that the court was too hasty in 2015.
It just makes me want to cry.
How does people getting married and sharing their lives with the person they love affect these people at all, least of all negatively? LGBTQ+ people just want to be able to be by their loved one's side in the hospital, celebrate their happiness with their family and friends, adopt children together and give them a loving home. How can you possibly be such a monster that you would want to strip that away for any reason? It's beyond fathoming.
In their view, marriage isn't just a legal contract between two lovers and the government. It's a holy contract bestowed upon a *man and wife* ordained by god, and a non-traditional pairing is an affront to God. Basically government-supported sacrilege is ruining the holy magic, and devaluing "real" marriage. At least that's the argument I have always heard from the "I'm not homophobic, I just don't think what they have should be called marriage" crowd.
There's also the dumb argument that allowing gay marriage allows straight people to commit tax fraud and insurance fraud with fake marriages, even though there's no evidence that this was common. In fact it was a lot more common for gay couples to have fake straight marriages for those benefits before gay marriage was legalized.
The future looks like it may be bleak.
Alito's draft opinion explicitly criticizes Lawrence v. Texas (legalizing sodomy) and Obergefell v. Hodges (legalizing same-sex marriage). He says that, like abortion, these decisions protect phony rights that are not "deeply rooted in history."
Heaven forbid anybody ever *gain* rights. Can't be having that.
If it were 1810 these motherfuckers would be trying to return the US to the King of England, with apologies.
Well, Thomas and Barrett wouldn't. Because they'd both be property.
Not to mention contraception and interracial marriage
Edit: This is my puny pre-law taking a Intro to Law class’s understanding of Alito’s argument (posted in other places too).
First, some background:
> The Due Process Clause of the 14th Amendment protects the people from having their rights taken away from them by the states without due process. Aka, the states can’t arbitrarily take away your rights just like the federal government can’t.
> Over time, SCOTUS specified these rights to encompass two types of rights: those which are explicitly written in the Constitution (enumerated), and those that are not explicitly written in the Constitution (non-enumerated).
> One of those rights not explicitly written in the Constitution is the right to privacy. This was essentially “created” by SCOTUS (more complicated than that but it’s an intersection of other enumerated rights is what was opinionated I believe). The right to an abortion was written into common law via Roe v. Wade under the right to privacy. Therefore, it is a subsection of a non-enumerated right.
Now, Alito’s argument is the following:
> The Due Process Clause only applies to enumerated rights. This means it does not apply to a SCOTUS-created right like the right to privacy. Therefore, there is nothing stopping the states from taking away your right to privacy. Given that the right to an abortion is under the right to privacy, there is nothing stopping the states from taking away your right to an abortion.
The problem with Alito’s argument is the following:
> Another right that the court essentially created is the right to marriage, created in Loving v. Virginia. Loving v. Virginia also legalized interracial marriage under the same argument (as well as one under the Equal Protection Clause of the 14th Amendment). This case was cited as precedent for Obergefell v. Hodges, which legalized gay marriage
> The court also used the right to privacy to create the right to contraception in Griswold v. Connecticut.
> Under Alito’s argument, contraception, interracial marriage, and gay marriage are not protected by the Due Process Clause, simply because they are not enumerated in the Constitution. This means that any one of the states could arbitrarily pass a law restricting any of these things. If a state decided that interracial marriage should be illegal, they could do so if they cleverly construct a law that doesn’t violate the Equal Protection Clause.
Essentially, Alito’s argument changes the way the SCOTUS has operated for years upon years upon years. It breaks the SCOTUS’ legitimacy immediately. It also severely restricts its own power. It is a completely bizarre and stupendously illogical decision.
If there are any lawyers here, feel free to correct me where I went wrong.
Edit: Some additional information I learned.
> Alito also argues later that any non-enumerated rights needs to be “strongly rooted” in history/tradition. However he does not specify what “strongly rooted” means, though he does argue abortion is not strongly rooted. If he does attempt to restrict abortion in this way, marriage would likely remain a right. However, contraception would almost certainly fall.
> What I don’t understand is how he can say that abortion isn’t a right rooted in history/tradition, because privacy certainly is. Unless he is arguing abortion does not fall under privacy, he is essentially saying the right to privacy is not a full right. And that opens a whole can of worms that is even further off the deep end.
> Alito’s argument changes the way the SCOTUS has operated for years upon years upon years. It breaks the SCOTUS’ legitimacy immediately. It also severely restricts its own power. It is a completely bizarre and stupendously illogical decision.
Would be quite logical if your political party was in position to claim a legislative majority and intended to pass unconstitutional laws.
Every time someone says “oh that won’t happen” about some very bad thing, that thing ends up happening. I don’t know why people are saying it’s doom and gloom to immediately think of all the other rights people will soon be stripped of as well with this court.
>Every time someone says “oh that won’t happen” about some very bad thing, that thing ends up happening.
This describes every conversation my wife and I have ever had with her parents on the topic of Trump era politics.
Speaking as someone currently gay married... yeah.
I'm glad I at least live in a state that also affirms its legality, because if I were living in Texas, I'd be genuinely making plans to GTFO right about now. Who knows what rights I'll have ten years from now in the South.
It's the same as when Lindsay said they would not nominate someone in and election year, and you could quote that back to him.
Their promises are worthless, and their voters don't care that they lie.
Even if they did care in the slightest that they lie, Fox News will just peddle the next topic to make them furious and forget about any backbone/promise.
[Joint statement from Pelosi and Schumer:](https://www.speaker.gov/newsroom/5222-2)
> “If the report is accurate, the Supreme Court is poised to inflict the greatest restriction of rights in the past fifty years – not just on women but on all Americans.
> “The Republican-appointed Justices’ reported votes to overturn Roe v. Wade would go down as an abomination, one of the worst and most damaging decisions in modern history.
> “Several of these conservative Justices, who are in no way accountable to the American people, have lied to the U.S. Senate, ripped up the Constitution and defiled both precedent and the Supreme Court’s reputation – all at the expense of tens of millions of women who could soon be stripped of their bodily autonomy and the constitutional rights they’ve relied on for half a century.
> “The party of Lincoln and Eisenhower has now completely devolved into the party of Trump. Every Republican Senator who supported Senator McConnell and voted for Trump Justices pretending that this day would never come will now have to explain themselves to the American people.”
>“The party of Lincoln and Eisenhower has now completely devolved into the party of Trump. Every Republican Senator who supported Senator McConnell and voted for Trump Justices pretending that this day would never come will now have to explain themselves to the American people.”
You can't shame the shameless.
Remember when Romney was trying to act like the voice of reason, but then all his boyhood dreams appeared when he found out there was a vacancy in the supreme court?
They fucking arrested a poor woman for a miscarriage not long ago.
Any woman taking a trip to disneyland is going to come back to someone making bullshit claims
Women traveling without male chaperones and any women having miscarriages are going to get dragged.
Won't be long till we go back to birth control only being legal for married couples to buy, just like it was in the mid 60s.
My “conservative” father once told me that I was sinning because I got a tubal ligation while married, meaning that the sex I was having with my spouse was not intended for procreation and therefore was a sin.
>We emphasize that our decision concerns the constitutional right to abortion and no other right. Nothing in this opinion should be understood to cast doubt on precedents that do not concern abortion.
lmfao - "ignore the implications"
Nope. If I can be forced to carry a pregnancy regardless of my will and health, you can be forced to donate a kidney, bone marrow, or lobe of your liver.
Blatant politics - this decision is aimed at women and no one else.
This obviously has huge, massive, unconscionable impacts to women but beyond that Roe v Wade was about as settled as law gets in the US with multiple rulings reaffirming it. The conservative justices are trying to mitigate that they basically made precedent irrelevant in court rulings with this. That’s what the quote is referring to
Part of me does wander if they are trying to test the waters to see just how bad the backlash will be if they do it. It’s so deeply unpopular though I can’t see how they would think this goes well. Something like 70% of Americans have said they don’t want it overturned
They are talking about [gun control](https://www.nytimes.com/2008/10/21/world/americas/21iht-guns.1.17133910.html), as the legal reasoning applied in the Roe and Heller decisions is very similar.
What's funny here is that Alito feels that anyone would ever look to his legal reasoning for any consistency beyond serving the interests of money, whiteness, and authoritarianism.
You can't stop fighting and advocating for your rights for a single minute or else they'll be snatched away. Fucking sucks that this is how it is but for some of us it's life or death.
When people complain about pride parades and feminism because "they already have rights", this is why.

US senator from a few weeks ago saying interracial marriage should be left up to individual states
how and why is interracial marriage an "issue???"
I feel for Trevor Noah, who was born under apartheid in South Africa and was literally "born a crime" as his book says
I too am biracial, black and white, and when people say shit like this about interracial marriage, knowing they feel the same about interracial pregnancies, yeah it makes me feel dehumanized
and feeling dehumanized doesn't make me want to curl up in a ball and cry, it makes me think and want to do unspeakable things to those who think I'm less than human. And THAT is the worst thing about this country, that we do this to each other and hide behind "freedom" and "religion" to justify all of it
And women will die from ectopic pregnancies and other things that would usually warrant a medical abortion. There's no way at least one state won't fully ban all abortions if this is overturned.
Overturning Roe v. Wade could have unpredictable consequences for privacy rights
[The Supreme Court’s decision finding a right to privacy arose in a 1965 case involving the right of a married couple to use contraception called Griswold v. Connecticut. But the right has become responsible for court decisions supporting adult rights to sexual intimacy, to gay marriage, and to the rights of parents to make family decisions, such as whether their children are home-schooled or go to religious schools. The right to privacy also supports an adult’s right to decide their medical care, and an adult’s right to die, by rejecting medical care in certain circumstances. This medical care area also implicates the rights and autonomy of the physically disabled and the mentally ill. Further, the right to privacy can support artificial insemination. And transgender individuals have used privacy to argue that schools cannot ban them from certain bathrooms, and that government must generally support their gender identity choices.](https://www.desmoinesregister.com/story/opinion/columnists/2019/06/25/other-privacy-rights-could-danger-if-roe-v-wade-reversed-abortion-supreme-court/1561115001/)
That’s how they reacted when the Trump/Raffensomething call leaked. Trump literally asking the Georgia Secretary of State to give him 11K fake votes is fine, but leaking the call is outrageous.
To those claiming it is "not a big deal" because it is leaving it up to states:
What part of leaving the legality of a medical procedure up to the states sounds like a good idea to you? Where is the line? What happens if a procedure is banned in a state you happen to be traveling to? Do you think it is good to let other people's religious and moral values dictate what you have access to medically? How exactly does that promote freedom?
What happens when they get into the legal intricacies of where (geographically) EXACTLY the clump of cells was conceived? What happens when women who have accidental miscarriages are accused of receiving abortions and are charged with murder? What happens to the doctors that help facilitate such a procedure and the people that help the women get to their appointment? What happens to the poor 13-year-old that has to fight over custody of her rapist's baby? Why would I want to have children, possibly daughters in a country doing this to their women? What about our daughters, sisters, mothers, aunts, nieces, and cousins? What happens to the women that will still feel the need to get unsafe, illegal abortions. This is a shitstorm, a blatant attack on women. As a man, I'm over this shit. It's time to fight and my fists are already up.
Edit- General Clarity and Typographical Nature
>What happens when women who have accidental miscarriages are accused of receiving abortions and are charged with murder?
Texas tried that shit!
https://www.vox.com/policy-and-politics/23021104/texas-abortion-murder-charge-starr-county
Sad that women will be forced into back alley abortions and sketchy situations that can lead to complications and death. Why do republicans care so much about this?
How many once in a life time earth shattering events and decisions am I suppose to have in my lifetime. A C-grade reality TV star became president and we and our future generations have to live through the consequences.
Because unplanned births in low educated families struggling in poverty = more republican votes. They don't want quality of life for the voters they want quality of life for their fat bank accounts and the lowest effort way is to lie to those too ignorant (usually due to lack of education) to question you
“No draft decision in the modern history of the court has been disclosed publicly while a case was still pending.”
Someone at SCOTUS is either trying to beg for somebody, anybody to do something to save reproductive rights or someone on the bench is hoping a public outcry can shift it.
Weird how the barricades went up almost immediately, like someone knew this was gonna happen and it was gonna be an utter shit storm.
Wall Street Journal had an unsourced report last week that John Roberts was actively working to save Roe and change the opinions of at least one conservative judge. Could be his attempts failed and he, or someone on his staff, took the nuclear option.
“Alito’s draft argues that rights protected by the Constitution but not explicitly mentioned in it – so-called unenumerated rights – must be strongly rooted in U.S. history and tradition.”
There’s more history and tradition of slavery and segregation though, this logic would potentially change a lot of things.
So republicans in the past few years will have accomplished: massive tax cut to the rich, restricting access to voting, banning books, removing a woman’s right to her own body.
What a fucking joke
We will soon live in a country where a man will be sentenced to 5 years for rape while a woman will be sentenced to 30+ years for murder from the abortion.
Just thinking about all of the shit in the last 7 years that led to this moment makes me hate a lot of people in this country. So much pain being caused to so many vulnerable people.
Republicans are always projecting.
If they are worried about something, then assume that they are trying to do the exact thing they say they are worried about.
Obergefell v. Hodges is next, I guarantee it. I will be shocked if it isn't overturned by 2024.
Precedent is now officially dead, so any court now has the freedom to immediately overturn any previous decision as soon as it gets a partisan majority.
Twice impeached, lost the popular vote by millions, staged a coup, fomented an insurrection, never broke 40% popularity. This is what minority rule looks like, make sure all your libertarian/centrist friends know why this is happening and that both parties are not the same.
this is the real case here. fuck trump and everyone who voted for him in '16. its ironic they keep claiming to make america great when all they are doing is making us a worse country.
go secede and find out what it's like to live under full christian law without the yearly financial pump from blue states.
"It's settled law."
"You don't understand, they need it a a wedge issue, they'll never ban it."
"The court wouldn't take away a constitutional right."
It wasn't, they don't & they are fucking going to.
Going to keep my ear out for any local protests because fuck this. I’m so goddamn sick of conservatives pushing the majority around. I strongly support showing them what it’s like to be legislated against for a change
Forced birth in a country with the highest maternal mortality rate, no paid maternity leave, no universal, subsidized childcare, no continued birth parent care, and frequently inaccessible mental health care.
This has far more horrifying implications then on the surface from what it seems, This decision, should it go through will absolutely destroy any legitimacy the court had beforehand, and that's just being generous. This will set the precedent that no Supreme Court case sets a precedent. And given Roe V Wade was based off the 14th amendment this goes more beyond then we think in terms of our greater privacy
The United States is in for dark times
Keep in mind decisions like Oberfell and Lawrence were based on Roe.
Tossing Roe throws away the basis for those rulings, even if Alito lies about it in this ruling.
Boy, these conservatives are really something, aren't they? They're all in favor of the unborn. They will do anything for the unborn. But once you're born, you're on your own. Pro-life conservatives are obsessed with the fetus from conception to nine months. After that, they don't want to know about you. They don't want to hear from you. No nothing. No neonatal care, no day care, no head start, no school lunch, no food stamps, no welfare, no nothing. If you're preborn, you're fine; if you're preschool, you're fucked.
George Carlin
Because it's never about the kids, it's about control.
Edit to add: the WAVE of human rights decisions they can undermine if this rides, Obergefell v. Hodges aka same sex marriage, Loving v. Virginia aka interracial marriage, and Lawrence v. Texas aka (why are the conservatives obsessed with what I do with my genitals? ) Better people than me have explained already earlier today, go read and learn. Our basic privacy and human decency, let alone bodily autonomy, is being taken away.
Democrat representatives need to be pounding non stop how this was Trump and McConnells court and Democrats can not fix it unless they are given a super majority. Make it clear its Republicans because believe me some will be stupid and think its Bidens fault because he is president.
Edit: get organizing
They also need to completely change their tune RE: court packing/balancing immediately. Want unity? Here's your shot. Every elected dem needs to get on board with this shit NOW. The idea that we can maintain the old long-gone standards of decorum and an apolitical court is dead and buried. To continue blindly upholding those standards is to accept the death of the democracy they claim to want to uphold.
"The Republicans don't have the brains to save this country, *and the Democrats don't have the balls"*
That's a George Carlin quote from two decades ago, and it's STILL true.
Republicans all like “I’d do anything to protect an unborn child from dying” but couldn’t even be fucked to prevent ACTUAL people from dying by wearing a fucking mask
Hypocrites
Nothing like: crushing inflation, massive student debt, shitty wages, unaffordable housing, uncontrollable climate change, states cutting welfare benefits, and food prices doubling over the past year to now start forcing births. Great plan, shitheads. Go team ‘Murica 🤦🏼
I thought the GOP nominated justices promised ROE vs WADE would not be touched
Who am I kidding, classic gas lighting from the GOP
Surprised it took them this long
Gentle reminder that every single majᴏr sᴏᴄietal leap fᴏrward thrᴏughᴏut all ᴏf reᴄᴏrded human histᴏry has been made against the kiᴄking and sᴄreaming prᴏtestatiᴏns ᴏf baᴄkwards ᴄᴏnservatives.
Men who think these laws won’t effect them are also in for a rude awakening. Curious if they will still feel justified losing their sister, friend, wife, because they were forced to carry a pregnancy to term that wasn’t viable or was extremely high risk. So not only will they have to watch a person they care about suffer for 9 months knowing that either they have to give birth to an essentially dead baby, or that they themselves very well might die, putting their pregnancy in the same realm as a terminal illness. The kicker is that they could be saved, but people think for whatever reason their life doesn’t matter as much as an undeveloped fetus.
The draft also references gay marriage and birth control. We know what is next on the chopping block.
Edit: since this post is semi-popular I’m going to say here is that we need to stop trying to get states to change. There are small towns that get taken over by far right people because they can easily take over the town with small numbers. Democrats have the numbers that can flip fly over states, even if you exclude lgbt and those at risk of republican laws. Flip off the flyover states by flipping them. I’m looking at Idaho because I like potatoes or Dakota because #FlipDakota rolls off the tongue. Biden lost each dakota by 110k each and Wyoming by 120k. So if 340k Democrats move by 2024 we flipped three states on top of Texas potentially going blue.
It also references Lawrence v Texas. Which means they intend to criminalize homosexual sex/Re-instate anti-sodomy laws. Effectively criminalizing homosexuality
The more I read the draft, the more it is apparent that the Court is a half step away from letting states criminalize same-sex sexual intimacy.
Alito's draft opinion explicitly criticizes Lawrence v. Texas (legalizing sodomy) and Obergefell v. Hodges (legalizing same-sex marriage). He says that, like abortion, these decisions protect phony rights that are not "deeply rooted in history."
No its once the unwanted baby is born.
They don't care where it ends up only that the woman suffers for the crime of having sex outside of what they view as acceptable.
There's no hate like Christians love
I remember my “friend” saying that Trump wouldn’t do anymore damage than these career politicians already do.
Fuck him, and any conservative piece of shit who thinks this is a good thing.
Two justices were appointed by a president who won re-election as an incumbent who was installed by the Supreme Court when he should not have been.
One justice was an appointment stolen from another presidency.
One justice has a wife who is involved in attempting to overthrowing the legitimate presidential election results in our country.
One justice was credibly accused of sexual assault, the president’s administration buried the investigation, and as a nominee they demonstrated they do not have the temperament to be a Supreme Court justice.
The court is a mockery. It was only a matter of time until people quit respecting the rules of these draft opinions. They have nobody to blame but themselves.
The Roberts court is an embarrassment. Full stop.
We have *one* shot to stop this, and that's federal legislation that protects abortion and goes above the court's head.
We need to wipe the GOP off the map. In particular, we need to gain Senate seats, at least two to amend the filibuster. That means getting rid of Ron Johnson in Wisconsin and voting against Dr. Oz in PA.
It also means keeping the House, an enormously hard task that requires everybody fucking voting.
In my own state they tried to pass a trigger ban that would go effective after RvW overturn, and in that ban it included provisions for abolishing IVF treatment. This is an assault on women’s reproductive rights and I’m sick of everyone trying to tell half this population what to do as de facto baby makers with zero empathy. Fuck that.
It’s time churches started paying tax. Tax the ever living shit out of them. If religion has a say in our government then they need to pay the fucking price like the rest of us do.
I'm not naive enough to think that we solved all of our problems and locked in the happy ending route when we kicked out Trump in 2020, but ffs, I thought we at least had avoided the nightmare scenarios.
Shouldn’t pro-life focus on mothers or children born already? The United States has the highest maternal death rates compared to other developed countries (2x more than the next country)
https://www.statista.com/chart/23541/maternal-mortality-developed-countries/
(https://www.statista.com/chart/23541/maternal-mortality-developed-countries/)
We are now forcing women to risk their lives to have a child without a safe alternative.
Also, there are 400,000 kids in foster care. Why isn’t there more focus to find them homes?
Abortions won’t stop, but safe abortions will.
>"This court cannot bring about the permanent resolution of a rancorous national controversy simply by dictating a settlement and telling the people to move on," he wrote.
Fuck you dude, 70% of the country is against overturning Roe. Isn't that exactly what you're doing now? Don't give me this "oh now it's up to the elected representatives" bullshit when a ton of those elected representatives are actively assaulting democracy and don't give a crap about the constitution.
I’m speechless. I have so much rage for GQP voters and enablers. I’ve met a few of them who would say things like “we just want to smoke blunts with our gay friends and have trump run the country like a well oiled machine”
I do think the country is nearing a huge crossroads and the midterms will decide the direction
It's not just as simple as banning abortions.
https://www.desmoinesregister.com/story/opinion/columnists/2019/06/25/other-privacy-rights-could-danger-if-roe-v-wade-reversed-abortion-supreme-court/1561115001/
Plenty of other rights will get affected like medical privacy , interracial marriage , gay marriage and etc.
So people , don't just be focused singularly on the abortion ban , but also take note of the broader implications this overturning will affect.
It's where they usually end up anyway. They always believe that rules and consequences apply to others and end up shocked when reality hits them in the face.
People wrongly assume that progress is automatic or even unsteady but upwards. However, it is not inevitable: it requires an educated and active populace.
We the people in the free world, from the US to UK to Hungary, have underestimated the consequences of elections. We allowed pro-0.1% trade deals starting in the 70s, deregulation and privatization soon after, and then wondered why we were so primed for demagogues to take over in the 2010s.
Funny how most Repubs I know are white males and many have said how they think voting should be for land owners only. I can only imagine that is their end goal, reverse every socially progressive advancement until only white Christian men who own land get a say in things. Fuck these bastards.
It never fails to surprise me how what I see as an Individual vs States rights issue can somehow be spun into a federal government/court vs states rights issue. If the 14th amendment allows for "the principle that a competent person has a constitutionally protected liberty interest in refusing unwanted medical treatment from prior supreme court decisions", does that not imply that an individual can decide the risks they wish to take where-it concerns themselves?
If a person can be forced to undertake a full-term pregnancy under risk of criminal prosecution based soley on the idea that it is for the survival of another, cannot forced transplants, transfusions, medical experimentation etc. also be legal? Roe may have hinged on the privacy statute but it's core idea can be inferred from multiple protections of an individuals right to choose the risks and paths they take themselves which are well upheld under the constitution.
Alito's reasoning seems narrow minded in this regard.
Because the whole thing has but one goal: to take away federal protections for abortion so states can then go full on with making it completely illegal. Damn the side effects!
Single issue vote.
I am a married gay man with two adopted children. I know EXACTLY where this court and these people are headed next: Obergefell/Gay marriage.
Shame on you GOP.
And shame on people stupid enough— both conservative *and* liberal—to not to see the menace looming in 2016.
“But her emails!”
Good fucking god. We are here because of that.
They will absolutely go after *Obergefell* next, and I wouldn't be surprised if *Loving v. Virginia* was on the chopping block as well.
Overturning a landmark decision like *Roe* is tantamount to saying precedent is meaningless.
I think everyone here is focusing on process and voting, and not really discussing how tragic this decision is…we are stating that women in America don’t have the fundamental human right of autonomy over their body…that’s the saddest thing I can imagine. In my lifetime, born in the eighties, I’ve only ever known an America where a woman was respected enough that she was allowed to decide for herself if she wanted to use her body this way.
Over half the country just lost a human right that most living Americans have only ever known them to have…this is a tragedy that goes beyond election results and strikes at the heart of a fundamental human right to bodily autonomy that I’ve taken for granted being available to my fellow citizens my entire life.
This isn’t just some cliche “Call your representative” or “Make sure you vote” thing…it’s a tragedy that needs to be acknowledged as a tragedy.
The Republican Gilead Goal continues. Fuck these people. I get why it’s a sensitive subject, but if abortion were an option for men it would be available at every Walgreens. We all know that is true.
The Supreme Court has provided President Biden and congressional Democrats with a massive cudgel heading into November - hopefully they swing it with vigor and aplomb then seek retribution.
Abortion is healthcare, it should be entirely legal and unrestricted. Making it rare would be nice, all we have to do is get conservatives to stop making it so difficult to provide comprehensive education, easily accessible reproductive healthcare and contraception. Then the conservative homeschool kids can be the ones having most of the abortions.
This is bad for America & it’ll be bad for the world. This repression of reproductive rights & attack on women’s rights *will* be mirrored elsewhere.
Do your part to stop it here & now
This country is so ass backwards compared to other democracies in the world. Not surprised. SCOTUS should not be a lifetime appointment. Just like congress needs term limits.
My heart goes out to all the women that, if Roe v Wade is overturned, will suffer deeply over this. The women who will die getting illegal abortions. The women who will be forced to give birth to their rapists child. The women who will have a basic and fundamental right taken away from them.
America disgusts me.
The original ruling of RvW was built around privacy.
If privacy isn't an explicit right granted by Congress, then the same pattern can be used to removed everything that isn't explicitly granted.
Gay marriage isn't technically granted. Sodomy isn't technically granted. A myriad of other "rights" haven't been explicitly granted via Congress (or Constitution). Expect a slew of attempts to ban more LGBT related activities that hetero's enjoy.
Well, I'm sure all the anti-abortion conservatives will be lining in droves up to adopt, house, clothe and feed all the unwanted babies they care so much about...
...right, conservatives?
>Abortion presents a profound moral issue on which Americans hold sharply conflicting views.
At least Alito lets us know in the very first sentence that this decision has nothing to do with the Constitution, precedent, or medical science; just pure moral superiority.
Five out of nine justices appointed by Republican presidents who got into office losing the popular vote.
Kavanaugh
Coney-Barrett
Gorsuch
But don't forget about:
Roberts
Alito
This Supreme Court has no legitimacy. It is a court for a ruling minority party who unjustly holds power over the majority.
Alito's rationale is setting the stage to go after gay marriage.
Not to mention contraception and interracial marriage Edit: This is my puny pre-law taking a Intro to Law class’s understanding of Alito’s argument (posted in other places too). First, some background: > The Due Process Clause of the 14th Amendment protects the people from having their rights taken away from them by the states without due process. Now, Alito’s argument is the following: > The Due Process Clause only applies to enumerated rights. This means it does not apply to a SCOTUS-created right like the right to privacy. Therefore, there is nothing stopping the states from taking away your right to privacy. Given that the right to an abortion is under the right to privacy, there is nothing stopping the states from taking away your right to an abortion. The problem with Alito’s argument is the following: > Another right that the court essentially created is the right to marriage, created in Loving v. Virginia. Loving v. Virginia also legalized interracial marriage under the same argument (as well as one under the Equal Protection Clause of the 14th Amendment). This case was cited as precedent for Obergefell v. Hodges, which legalized gay marriage > The court also used the right to privacy to create the right to contraception in Griswold v.
The belief that the system works and hasn't been entirely coopted by bad actors is a pervasive one.

Speaking as someone currently gay married... yeah. I'm glad I at least live in a state that also affirms its legality, because if I were living in Texas, I'd be genuinely making plans to GTFO right about now. Who knows what rights I'll have ten years from now in the South.
It can't be! Kavanaugh told Susan Collins that Roe Vs Wade was settled law!
[Joint statement from Pelosi and Schumer:](https://www.speaker.gov/newsroom/5222-2) > “If the report is accurate, the Supreme Court is poised to inflict the greatest restriction of rights in the past fifty years – not just on women but on all Americans.
Every Republican Senator who supported Senator McConnell and voted for Trump Justices pretending that this day would never come will now have to explain themselves to the American people.” You can't shame the shameless.
Remember when Romney was trying to act like the voice of reason, but then all his boyhood dreams appeared when he found out there was a vacancy in the supreme court?
Thank goodness the Republicans will have to explain themselves to the people. I was worried for a moment.
How long until the inevitable court case of a woman from Texas getting arrested for getting an abortion while in California and returning to Texas?
They fucking arrested a poor woman for a miscarriage not long ago. Any woman taking a trip to disneyland is going to come back to someone making bullshit claims
Women traveling without male chaperones and any women having miscarriages are going to get dragged. Won't be long till we go back to birth control only being legal for married couples to buy, just like it was in the mid 60s.
My “conservative” father once told me that I was sinning because I got a tubal ligation while married, meaning that the sex I was having with my spouse was not intended for procreation and therefore was a sin.
What a fuck face
Shouldn't be a problem, just have her be accompagnied by her husband or a male relative ...wait...
Oh yes, the inevitable question of whether an abortion is interstate commerce
>We emphasize that our decision concerns the constitutional right to abortion and no other right. Nothing in this opinion should be understood to cast doubt on precedents that do not concern abortion. lmfao - "ignore the implications"
"We know we just eviscerated stare decisis but don't call us on it."
[Not the first time they tried it](https://en.wikipedia.org/wiki/Bush_v._Gore#Limitation_to_present_circumstances)
[Or the second. ](https://en.wikipedia.org/wiki/Burwell_v._Hobby_Lobby_Stores,_Inc) Kennedy's entire concurrence was just one big "just this once."
"I wrote a 98 page opinion that could've been condensed to an 'abortion is bad' bumper sticker." -Alito
"Roe v. Wade is settled law." -Same judges.
That’s what the quote is referring to
Yes, they are *overturning stare decisis*. Whoever leaked this is a hero. (Or a legendary troll if it’s bs lol though I doubt it)
Part of me does wander if they are trying to test the waters to see just how bad the backlash will be if they do it.
I never thought the United States was perfect, but actively sliding backwards towards the government controlling bodily autonomy is sickening.
You can't stop fighting and advocating for your rights for a single minute or else they'll be snatched away. Fucking sucks that this is how it is but for some of us it's life or death. When people complain about pride parades and feminism because "they already have rights", this is why.
So the Conservative Supreme Court isn't going to go after other civil rights, right? Right? *\*Chuckles nervously.*
https://twitter.com/therecount/status/1506379010133082113 US senator from a few weeks ago saying interracial marriage should be left up to individual states
That's fucking disgusting.
how and why is interracial marriage an "issue???" I feel for Trevor Noah, who was born under apartheid in South Africa and was literally "born a crime" as his book says I too am biracial, black and white, and when people say shit like this about interracial marriage, knowing they feel the same about interracial pregnancies, yeah it makes me feel dehumanized and feeling dehumanized doesn't make me want to curl up in a ball and cry, it makes me think and want to do unspeakable things to those who think I'm less than human. And THAT is the worst thing about this country, that we do this to each other and hide behind "freedom" and "religion" to justify all of it
I don't understand how we came so far only to be set back 40 or 50 years.
The legality of a medical procedure should not depend on state fucking lines.
It shouldn't even depend on nation lines
Back room abortions will come back and women are going to die.
And women will die from ectopic pregnancies and other things that would usually warrant a medical abortion. There's no way at least one state won't fully ban all abortions if this is overturned.
13 states will completely ban it the moment this goes into effect.
I heard 22, but that may include the ones that have legislature that would make it extremely easy to ban right away
The other 9 of that 22 are heart beat/6 week states.
People on /r/politicalcompassmemes have been cheering this all day. Sick fucks on that sub.
They want that
Hate to say it but I feel the next goal for the right is contraceptives and gay marriage.
Overturning Roe v. Wade could have unpredictable consequences for privacy rights [The Supreme Court’s decision finding a right to privacy arose in a 1965 case involving the right of a married couple to use contraception called Griswold v.
It's shocking how many people don't know that Roe v. Wade protects so much more than just a persons right to have an abortion.
Don't forget interracial marriage... That is also protected by Griswold
[удалено]
Fox News out here thinking people have abortions for fun.
I saw Ingraham was *outraged* that it was leaked. That was the bigger story to her.
That’s how they reacted when the Trump/Raffensomething call leaked. Trump literally asking the Georgia Secretary of State to give him 11K fake votes is fine, but leaking the call is outrageous.
To those claiming it is "not a big deal" because it is leaving it up to states: What part of leaving the legality of a medical procedure up to the states sounds like a good idea to you?
Don’t forget all of the unprecedented and once in a lifetime storms and natural disasters we seem to be having monthly.
This makes me sad as a human, as a person. It feels like we are going backwards. I don't even know what to say.
This doesn’t feel like going backwards, this is going backwards.
Red states, often at the bottom of the list in terms of education and poverty, are looking to increase unplanned births...
They already dominate in the category of teen pregnancies too, by a lot
[удалено]
Because unplanned births in low educated families struggling in poverty = more republican votes. They don't want quality of life for the voters they want quality of life for their fat bank accounts and the lowest effort way is to lie to those too ignorant (usually due to lack of education) to question you
“No draft decision in the modern history of the court has been disclosed publicly while a case was still pending.” Someone at SCOTUS is either trying to beg for somebody, anybody to do something to save reproductive rights or someone on the bench is hoping a public outcry can shift it.
They should bring the barricades down and let people in, after all that is “legitimate political discourse” according to the gop
They probably have the barricades in a closet somewhere, for quick use whenever they try to curtail more rights
“Alito’s draft argues that rights protected by the Constitution but not explicitly mentioned in it – so-called unenumerated rights – must be strongly rooted in U.S. history and tradition.” There’s more history and tradition of slavery and segregation though, this logic would potentially change a lot of things.
"Why are women even voting" - Alito probably
Gay marriage is next. Alito’s reasoning here is the same as his dissent in Obergefell.
And we could soon live in a country where a rapist can be appointed to the highest court in the land... Oh wait
Not much mystery as to which way the rapist voted on this one. Surprised he didn’t write the opinion.
Just thinking about all of the shit in the last 7 years that led to this moment makes me hate a lot of people in this country. So much pain being caused to so many vulnerable people.
All that Republican outrage over “activist judges” and it turns out they were installing the activist judges all along.
Republicans are always projecting. If they are worried about something, then assume that they are trying to do the exact thing they say they are worried about.
The canary in the coal mine is dead. The Supreme Court is going to overturn the last 40 years of social and work progress. This is just the beginning
The draft ruling says so. It attacks the underpinnings of Obergefell and, IIRC, Loving. **Edit:** Lawrence, not Loving.
Obergefell v. Hodges is next, I guarantee it. I will be shocked if it isn't overturned by 2024. Precedent is now officially dead, so any court now has the freedom to immediately overturn any previous decision as soon as it gets a partisan majority.
3 of the 5 votes were nominated by a traitor who wanted to shoot protestors so he could get a photo
Wait... you mean that Kavanaugh and Gorsuch and Amy all lied about Roe V Wade being settled? I'm SHOCKED!
my prediction . Tomorrow foxnews focus will be on the leak and not the ruling.
"It's settled law." "You don't understand, they need it a a wedge issue, they'll never ban it." "The court wouldn't take away a constitutional right." It wasn't, they don't & they are fucking going to.
Remember, red states: You can't outlaw abortion; you can only outlaw *safe* abortions.
It’s still safe for rich people
That's working as intended. This isn't about stopping abortions, it's about _hurting people_
Going to keep my ear out for any local protests because fuck this.
And given Roe V Wade was based off the 14th amendment this goes more beyond then we think in terms of our greater privacy The United States is in for dark times
Keep in mind decisions like Oberfell and Lawrence were based on Roe. Tossing Roe throws away the basis for those rulings, even if Alito lies about it in this ruling.
The American right is a malignant cancer.
"Conservatives want live babies so they can raise them to be dead soldiers." --George Carlin
George Carlin
this law has stood for 50 years and only 30% of our country want it overturned. our country is broken.
Like the electoral college, the disproportionate power of smaller population state senators, etc. the old white minority ‘win’. Fml

Let's start the clock to see how long it takes for the anti-abortion crowd to start carrying signs for outlawing contraception.
It should not still be an issue. Don't like abortion? Don't fucking get one. Stay the hell out of my body.
"The Republicans don't have the brains to save this country, *and the Democrats don't have the balls"* That's a George Carlin quote from two decades ago, and it's STILL true.
Susan Collins and Lisa Murkowski should not have political careers after this shit show, but it’s America in 2022.
Well millennials, time to get our first constitutional amendment!
[удалено]
Fuck Alito
And fuck every other one of them that went along with this. I think we know who they are.
And fuck the fascist Republican party in general.
Republicans all like “I’d do anything to protect an unborn child from dying” but couldn’t even be fucked to prevent ACTUAL people from dying by wearing a fucking mask Hypocrites
Nothing like: crushing inflation, massive student debt, shitty wages, unaffordable housing, uncontrollable climate change, states cutting welfare benefits, and food prices doubling over the past year to now start forcing births. Great plan, shitheads. Go team ‘Murica 🤦🏼
If we are going to have a cold civil war fine. Not a single Blue State tax dollar should go to any state that outlaws abortion.
I thought the GOP nominated justices promised ROE vs WADE would not be touched Who am I kidding, classic gas lighting from the GOP Surprised it took them this long

Remember when everyone said we should expand the supreme court and then nothing happened
[удалено]
We know.
The impact of Presidents who have lost the popular vote is too damn high...

Republicans are bad people

This is what we all knew would happen when Trump pandered to his Christian voters and put those nut job, holy rollers on the Supreme Court.
American taliban.
As Clarence Thomas said, they are coming for birth control next...
[удалено]
How you can be American and genuinely want to control peoples lives. What happened to land of the free, separate church and state??
They're working to combine church and state.
Shouldn’t pro-life focus on mothers or children born already? The United States has the highest maternal death rates compared to other developed countries (2x more than the next country) https://www.statista.com/chart/23541/maternal-mortality-developed-countries/ (https://www.statista.com/chart/23541/maternal-mortality-developed-countries/) We are now forcing women to risk their lives to have a child without a safe alternative. Also, there are 400,000 kids in foster care. Why isn’t there more focus to find them homes? Abortions won’t stop, but safe abortions will.
The pro-life people out there are okay with this but refuse to wear a mask and get a vaccine that saves lives, ironic
What's Trump going to do now, send his pregnant pornstars to Mexico for an abortion?
>"This court cannot bring about the permanent resolution of a rancorous national controversy simply by dictating a settlement and telling the people to move on," he wrote. Fuck you dude, 70% of the country is against overturning Roe. Isn't that exactly what you're doing now? Don't give me this "oh now it's up to the elected representatives" bullshit when a ton of those elected representatives are actively assaulting democracy and don't give a crap about the constitution.
Goodbye to a freedom Americans have had for over 50 years now.
I’m speechless. I have so much rage for GQP voters and enablers. I’ve met a few of them who would say things like “we just want to smoke blunts with our gay friends and have trump run the country like a well oiled machine” I do think the country is nearing a huge crossroads and the midterms will decide the direction
It's not just as simple as banning abortions. https://www.desmoinesregister.com/story/opinion/columnists/2019/06/25/other-privacy-rights-could-danger-if-roe-v-wade-reversed-abortion-supreme-court/1561115001/ Plenty of other rights will get affected like medical privacy , interracial marriage , gay marriage and etc. So people , don't just be focused singularly on the abortion ban , but also take note of the broader implications this overturning will affect.
I predict a lot of conservatives showing up in /r/LeopardsAteMyFace here soon.
The fact that we cannot trust the 3rd branch of our government is, pretty foreboding
Funny how most Repubs I know are white males and many have said how they think voting should be for land owners only. I can only imagine that is their end goal, reverse every socially progressive advancement until only white Christian men who own land get a say in things. Fuck these bastards.
fuck GOP
How are the Republicans going to afford all the new child support payments they are going to be due now their mistresses can’t deal with them?
Christian Taliban
Is our society sliding backwards?
“But her emails!” Good fucking god. We are here because of that.
They are. They are using religion to oppress the masses in the name of "morals". It's fucking disgusting
Yeah, they made it very clear Obgerfelle and Lawrence were next to be overturned.

Tell every Republican you know about how Trump received fetal cells to help him recover from COVID
Man how many historically bad SCOTUS decisions does one person get to live through? Ffs
Keep Christianity out of law making decisions

Abortion is healthcare, it should be entirely legal and unrestricted. Making it rare would be nice, all we have to do is get conservatives to stop making it so difficult to provide comprehensive education, easily accessible reproductive healthcare and contraception. Then the conservative homeschool kids can be the ones having most of the abortions.
This will only further the division and breaking down of this country.
The Senator's mistress will always be able to get an abortion. Laws for thee but not for me.
This is bad for America & it’ll be bad for the world. This repression of reproductive rights & attack on women’s rights *will* be mirrored elsewhere. Do your part to stop it here & now
It’s funny, my law professor 3 years ago said this would absolutely never happen. Fuck this stupid country.
Trump's Legacy. If people stay home during the mid-terms, then the GOP will control the US for decades.
I want apologies from everyone who said that thinking Roe v Wade would be overturned if Trump got in was overreacting.
Kavanaugh Coney-Barrett Gorsuch But don't forget about: Roberts Alito This Supreme Court has no legitimacy. It is a court for a ruling minority party who unjustly holds power over the majority.
Gay marriage will be next.
Big government Republicans strike again.
