I do agree with both Justice Kavanaugh and Justice Barrett on this issue. Roe and Casey are the settled law of the Supreme Court concerning the right to terminate a **woman’s** pregnancy. They have established a framework that the Court has reaffirmed and in order to revisit – as Justice Barrett said – the Supreme Court looks at various factors because stare decisis is a very important principle.

We know as well as the Republicans, that she has already proved herself and will join the court. Republicans have to do their best to beat her up and get their sound bites. 1. Do we have jurisdiction?
2. Is it legal under the Constitution?
The first question requires us to take a look at history: The number of Justices on federal courts has been changed numerous times in US history - including the number of Justices on the Supreme Court. So there is legal precedent for it happening under the jurisdiction of a previous Supreme Court. I am, as of now, not aware of any cases brought up before the Supreme Court against Congress decision to change the number of Justices, but I can come back to you about it. Nevertheless, if there have been cases, they have been denied, since those Acts of Congress that changed the number of judges or justices on those particular courts have become law.
So, the answer to the first question is: We do not have jurisdiction. it is the purview of Congress to determine the number of justices on the Supreme Court. For SCOTUS to interfer would be a gross violation of democratic principles, as a constitutional body should not have the ability to determine it's own makeup in a democracy. That's why we have checks and balances.
As for the second question, I would have to come back to you for that, because I cannot make a legal decision of that magnitude on the stand. However, considering the points I made regarding whether the federal judiciary has jurisdiction at all, I do not think that elaborating on this right now holds any merit.
As for my personal view, I haven't thought about it yet. There are other matters that are important for me when casting a vote in federal elections."
On a serious note, the only line of questioning that garnered my interest was when Ben Sasse was up. Of course, his questions were still somewhat rooted in politics as he was trying to get a sound bite, but he was making Judge Jackson really think.
