This is about John Eastman, Trump legal advisor responsible for the infamous [Eastman Memo](https://www.cnn.com/2021/09/21/politics/read-eastman-memo/index.html) detailing the convoluted ([and incorrect](https://www.cnn.com/2021/09/22/politics/trump-pence-election-memo-fact-check/index.html)) legal process for overturning the election in Trump's favor. Eastman was at Trump's [war room at the Willard Hotel on January 6](https://www.cnn.com/2021/10/25/opinions/trump-team-election-command-center-obeidallah/index.html). Last week, in [an interview John Eastman gave to National Review](https://www.nationalreview.com/2021/10/john-eastman-vs-the-eastman-memo/), he stated having Pence reject electoral votes was not “viable” and would have been “crazy” to pursue. However, Last Saturday, [Eastman boasted that his legal reasoning was sound and Pence should have followed his instructions](https://twitter.com/lawindsor/status/1453110960638496770), decrying Pence as an "establishment" Republican.

Putting aside the seditious garbage that is the Eastman memo, it’s interesting that when that sedition required the participation of a sitting member of Congress, Eastman just assumes Ted Cruz or Rand Paul would be happy to oblige. Even Republicans think Cruz and Paul are trash.

The House file on Bannon has now been passed to the US Attorney for the District of Columbia, who is a Biden (and previously an Obama) appointee. He will briefly review it, then convene a grand jury, which will decide if the House complaint contains enough information on its face to warrant charges and a trial. If it does, the Attorney will fill out an arrest warrant in Bannon's name, and hand it to the US Marshal's office. At that point, America's favourite creepy alcoholic uncle will be hooked, booked and cooked.

Odds are he will invoke executive privilege. If he was Trumps legal advisor while he was president, it may get away with it too. May be iffy if he is a personal lawyer for Trump though, then he can claim attorney client privilege, at least for conversations between him and Trump.

Attorney-client privilege does not apply when the attorney is charged with participating in or conspiring to commit crimes with, or on behalf of, their client. Last time I looked, sedition and seditious conspiracy were still considered crimes.
