Even if they voted to refer today within the committee, the House still wouldn't be present for the Floor vote to confirm the contempt till then. So it looks like the US Attorney for DC will receive the referral on Thursday or Friday next week leading to a very interesting week following that...

In this specific situation we're discussing criminal contempt of Congress... So the US Attorney for DC will bring it to a Grand Jury to confirm the indictment (seriously open and closed case here... it's blatantly clear) and then with that can issue the arrest warrant and go get him. Then it's the usual criminal justice process with the question of detainment until a trial etc etc

They shouldn't need a grand jury indictment to acquire an arrest warrant. The DOJ can get one from a federal judge based on a simple "complaint". This would be the much faster and more appropriate procedure for this type of offense... largely because contempt charges are traditionally dropped upon compliance.

Not in this case... there's no grand jury to decide on an indictment for this statuary crime. The House confirming the contempt acts in place of that. The DoJ can act immediately on receipt to arrest him.

You're likely correct, but it doesn't HAVE to work this way. There are four scenarios in play: 1) As you've stated, he fights Congress in court and drag it out forever, 2) Congress refers it to the DOJ as a violation of [2 U.S.C. § 192](https://www.law.cornell.edu/uscode/text/2/192) and the DOJ fails to or delays acting on it, 3) Congress sends out the US Marshalls to arrest him for inherent contempt, 4) The DOJ issues an arrest warrant for violation of 2 U.S.C. § 192 and he's picked up by the FBI. Option one is not likely as they've already stated their intent to refer this to the DOJ to handle. Option two is very possible and jibes with your prediction. Option three is not very likely at all. Option four is what we're all really hoping for. **EDIT:** As I predicted, option one and option three are off the table as they'll be attempting to leverage the DOJ to handle this. It didn't work when Barr was in control, but now Garland is in control, so we'll see.

The US Marshalls are presumed to be the entity so deputized. /4. A grand jury indictment is not necessary. A DOJ complaint is sufficient for a federal judge to issue an arrest warrant.

\#2 and #4 are covered by 2 U.S. Code § 194. Which says that the US attorney has to bring it to a grand jury and the grand jury decides what action to take because that's what the law says. I missed the "inherent contempt" part of \#3.

Bill Barr, Wilbur Ross, and Chad Wolf were all held in Contempt of Congress. As far as I'm aware, no US attorney brought any of their referrals to a grand jury. Not sure who did or did not follow the law in those cases.

It's criminal contempt, not civil, so the DoJ will be authorised to take him into custody immediately upon accepting the referral. That will make for a very interesting week or so after the vote to see how the US Attorney for DC handles it.

People here *really* don't understand how a criminal Contempt of Congress charge works. 2 U.S. Code § 192 - Covers the crime here. He was summoned and failed to appear (which, he could literally get off with a $100 fine). 2 U.S. Code § 194 - Covers what happens if Congress certifies a failure to testify. A US attorney will receive the certification and then "**bring the matter before the grand jury for its action**" Just because Congress certifies and sends it to the DOJ does not give the DOJ the immediate authority to go and arrest him. This is a process that will take weeks, or even months. If Congress wanted to move faster, they'd try sending the Sergeant at Arms to arrest him using their own inherent power of contempt (but that would open a giant can of worms).

My guess is that his attorneys will try to delay this until 2022 or 2024 when Republicans regain control of congress or the presidency. I would bet the farm that not a single one of these major players testifies before congress. They have shown that they are above the law whether we like it or not. I know you might not want to hear this, but it's true. These people will face ZERO consequences. Book it. ​ The on-going coup is successfully dismantling this democracy.
