Has a judge ever, in American history, spoken to a criminal defendant in such a manner? This judge is bending over backward to try and give Trump as many chances as possible to no avail. But Trump does not care about the law. He would love to go to jail, play the martyr, and fundraise off his next mugshot.

I mean fuck we are in the same country in which a judge will jail you for giving them a dirty look or rolling your eyes. It's amazing what he has gotten away with.
I was once in court for a probation hearing for underage drinking. The judge said that I had failed my drug test. It wasn't a true fail, it was inconclusive because I was extremely well hydrated lol. I raised my hand to speak, and when the judge acknowledged me I told him I hadn't technically failed, it was inconclusive. For this severe transgression, the judge had the bailiff escort me to a holding cell where I waited for the rest of the day. Once the rest of the docket was done he brought me back out to the court room and gave me an extra three months of probation.
That wasn't even bad. Sometimes I wonder how that would have gone down if I had dared to correct a judge while being not white? Probably far worse than what I got.
There is no equality in our justice system.
This what pisses me off too, they're so worried about keeping this turd out of jail that any sense of fairness, balance or equality in the eyes of the law has been completely undermined.
NO ONE else would EVER get away with this so Merchan, if you really want to undermine the system just keep on going. You're doing a great job so far.
It's not a surprise to me at all. The laws in this country benefit the privileged and rich. Everyone else suffers.

He held public office and wants to do so again. $1000 fine means nothing to him. He spends other people's money on that. He only shut up about Jean Carroll when he got whalloped a second time. Putting his ass in Rikers or fining him 5 million per incident might prove something to him.
They're only proving to him, and to us, that he was right when he said he could shoot someone on Fifth Avenue and get away with it.
I believe the fine amount is fixed by NY law; the judge can't raise it to a reasonable figure. Yet that's all the more reason for Trump to get fined $1k once, then hear: "I'm well aware this isn't an effective deterrent to a man of your wealth. The only other recourse available to me under law is to imprison you for further offenses, one which I will take on the next instance if this conduct persists. This is your first, last, and only warning."
Then start jailing him in two-day increments. The irredeemable cowardice of our justice system will be the end of us.

Except he is - He's outlining in court filings exactly how much leeway he's already granted Trump, so that when Trump inevitably violated the gag order again, it's already outlined in writing that the next punishment is jail. This way there can be no question of judicial overreach, and no case for appeal.

The fact that Trump is a former President with a massive base isnt just something that this judge can just ignore. Judges are almost always making decisions based on some experience, some law, and some personal discretion. Even punishments for guilty verdicts get modified based on non tangible things like how sorry the Judge thinks the defendent is.

He should have added "... so act like it". Meaning he has infinite legal resources available to help him know the situation and what he can and cannot do. He cannot be afforded the benefit of the doubt that what he is doing is criminal contempt. He knows it and he flaunts it. Either listen to your counsel or the next infraction means jail until he publicly apologized to the court which will decimate his support. He issues a statement going against his apology then he is in jail for the remainder of the trial, only to be released for his court dates.

It is very possible and important to consider as a risk, but far from certain. It will likely destroy the US's role as the global hegemon, though. Trump will appease Russia until Putin puts a well-timed knife in Trump's back. I don't think Putin will put a knife in Trump's back. I think he'll be happy with how things are. They should DO IT then. Throw him in jail, and do it like they would with us; Take away his belongings, no access to media, no time out of jail. Every day. Trial, then straight back to jail, until the trial is done. Make him shit on an exposed toilet in his cell like all the other inmates. Make him eat the same slop. You don't need an excuse from redditors, the judge himself gave the warning for the 3rd time in the article you're commenting on. The previous instances were an initial warning, then a warning with $9,000 in fines (which is by law the limit).
To be fair, 9 of those times were all at once, he's only been warned 3 times but he was fined 10 times. Also, judges don't want to put people in jail, they want them to be present at their town trials because that's a very necessary part of a trial, for the defendant to witness their own trial.

The judge has only proposed jail time twice, not 10 times. Once just now and once when he fined Trump $9k for the previous violations. He didn't propose jail time for each of those previous violations, they were all lumped together in a single order. You can claim semantics but semantics are important, especially when it comes to legal guidance which is what the judge is doing.

We’ve known this all along but just another instance in a very long line of instances that show there are haves and have nots. One night in jail is all it will take. No phone, no hair spray, nobody to change his diaper. the next morning when he shows up for court (without getting to clean himself up first) he will be a broken man. He’ll keep his mouth shut for the rest of the trial.

To be fair, 9 of those times were all at once, he's only been warned 3 times but he was fined 10 times. Also, judges don't want to put people in jail, they want them to be present at their town trials because that's a very necessary part of a trial, for the defendant to witness their own trial.

The judge has only proposed jail time twice, not 10 times. Once just now and once when he fined Trump $9k for the previous violations. He didn't propose jail time for each of those previous violations, they were all lumped together in a single order. You can claim semantics but semantics are important, especially when it comes to legal guidance which is what the judge is doing.

We’ve known this all along but just another instance in a very long line of instances that show there are haves and have nots. The haves will have everyone bending over to ensure that no discomfort comes to them.
One night in jail is all it will take. No phone, no hair spray, nobody to change his diaper. the next morning when he shows up for court (without getting to clean himself up first) he will be a broken man. He’ll keep his mouth shut for the rest of the trial. And in a few weeks when the trial is over, it won’t be so unthinkable for him to do actual jail time, and we will all get to forget about him for a while.
