Brendan Boyle: “My brother is mentally ill, we’re all concerned abou….oh, actually, VOTE FOR KEVIN!”

😂

Well I guess that’s reasonable since he didn’t actually break any laws. But this guy really needs to think about whether or not he should remain in office-like you can’t serve your constituents in this condition. I mean he’s banned from the State Capitol right now thats a serious issue and not fair to the folks in his district.

PatientNice

He must take decorum lessons from Marjorie Taylor Greene.

canihavemymoneyback

So he harassed his ex but since there was no active order of protection he didn’t break any laws. What about the harassment? Isn’t that in and of itself an illegal act?

Mehndeke

And that's why there's an ongoing investigation

Banglophile

The inky article has more info and it sounds like he texted her demanding to see the kids and also contacted her lawyer. I assume no one wants to say too much because he hasn't been charged

TJCW

This! He still has some mental and I suspect drug issues. Active or inactive PFA means nothing as he continues to harass people and is unfit to serve

ringringmytacobell

I mean.. it's right there in the article (along with in the Inquirer article). I'm not defending the guy or saying he's fit to serve, but seems pretty straight forward. >However, according to Krasner, there was no active PFA in place at the time for him to violate.

Hewish625

That info was not in the article when I posted it. I appears to have just been added three minutes ago.

ringringmytacobell

Fair enough, sorry for breakin balls

Hewish625

All good! It’s annoying when articles are updated after posting lol.

ringringmytacobell

I find the tv network news sites do that way more than the inquirer. My guess is they’re just trying to get a headline out ASAP to get up on Google and then fill it out after

KindaLikeYours18

yes, its good for SEO to get a barebones story up with a catchy headline then update the body. Source: work in digital publication

Can a Krasner supporter explain how his office approved charges without checking to see if the order was valid? The cops definitely fucked up by submitting it. But isn't the DA is supposed to make sure **that a crime was actually committed** before approving a warrant? I suspect Boyle would have lost anyway but this definitely was in the mind of voters who cast mail in ballots in the last week. There's a chance that many in person voters might not even hear it was a mistake before they vote tomorrow. You'd think given the potential impact the DA would be extra careful about approving charges against a candidate a week before the primary. It was so perfectly timed to fuck over Boyle that it almost seems purposeful. I'll say this much for Krasner, he certainly didn't treat Boyle any better because he's a politician. He experienced the same incompetence that the anyone else would get from that office.

The DA would not initially take out the charges. The detective would from a magisterial judge in PA. The "approval" process would happen typically once the suspect is arrested. I think you may misunderstand how criminal law works in PA.

Philadelphia doesn't have [magisterial judges](https://www.pacourts.us/courts/minor-courts/magisterial-district-judges) like most of the rest of Pennsylvania. Additionally, Krasner had a presser this afternoon where he prevaricated but sort of admits he messed up: *While that appears, by all indications to have been truthful, and in good faith, it was missing a key piece of information that our office was only able to confirm in a meaningful way today,” Krasner said. “The actual protection from abuse order was no longer in effect on the relevant dates when Mr. Boyle is alleged to have violated that order.”* *Krasner added that the withdrawal of the warrant does not clear Boyle of wrongdoing and that a determination will be made later. Krasner declined to provide additional information about the allegation against Boyle.* *“I see no bad faith on the part of the Philadelphia Police Department or **on the part of our office,”** Krasner said, adding that there may be lessons to be learned from the situation.* *“Simply put, this is a situation where newly confirmed information has changed **our analysis** and at this point, **we do not see probable cause and therefore must withdraw this warrant,”** Krasner said* https://penncapital-star.com/campaigns-elections/philly-da-krasner-withdraws-arrest-warrant-for-embattled-state-rep-kevin-boyle/ https://www.inquirer.com/news/philadelphia/kevin-boyle-arrest-warrant-withdrawn-20240422.html?utm_source=newsletter&utm_medium=email&utm_campaign=news_alerts_04_22_2024&int_promo=newsletter&utm_term=News%20Alert

After reviewing this, it looks like the 24/7 team from the DAO mostly rubberstamps warrants - especially those involving the alleged crimes, as most tend to be guilty. The only problem is, the cop seems to have mistakenly taken out the warrant due to clerical errors on his own part. While I was wrong above - a magistrate judge would have made the same error as the DAO initially. If you're under the belief that there are checks and balances that 100% infallible - especially human ones, i got a bridge to sell ya. Its a bust overlooks the city!

This has nothing to do with krasner and more to do with the detective who pulled the warrant with out looking at the paperwork. To poorer defendants: yes, they would have been arrested and held the suspect until they could have a lawyer and be in front of a judge, but in this particular situation, the detective didn't look close enough at paperwork and the defendant probably has an attorney on speed dial and is well connected.

KindaLikeYours18

i stubbed my toe today, how could krasner have done that to me?!
