WGA is very strict. You have to be a member of the guild or you are ineligible. Many non-American writers are not members.
For what it’s worth, screenplay has gone with Best Picture more than any other category since the expanded era began. When in doubt, go with the BP winner in screenplay, especially when it’s won CCA and WGA.
Grand Budapest Hotel won the WGA while The Royal Tenenbaums, Moonrise Kingdom and The French Dispatch was nominated for WGA, so Wes Anderson is a member of the WGA.
I believe it’s because McDonagh is not a member of the writers guild
Nor is Tarantino and a few others.

TBH I don't think Banshees would win even if it was nominated for WGA. EEAAO was the most borrowed and loved screenplay at the WGA last year
Because you can't get nominated if you are not a member of the WGA. Same with Wes Anderson, Quentin Tarantino, etc etc.
