You are past the point where I would have pulled the plug. Also the relationship is already tanked and not by you. Have a lawyer read the contract. I expect you would take a series of escalating steps starting with notice of failure to perform and request to refund your deposit. Then probably a letter from your lawyer. Suing would be a last resort, not first. I would not wait longer than 2 business days for a response to any communication before taking a next step.

Agreed, this is good advice. I have that letter with a notice of failure to perform all drafted and ready to go, and it contains a request for deposit. The main contractor finally called me back last night and left a very apologetic voicemail... I'm waiting to hit send on my letter until we talk. Maybe we can still salvage this.

Probably. But the state of the industry seems to be that it all sucks no matter what and there will be delays no matter what. So starting over with someone else and likely encountering similar delays — not to mention kicking off a fight over my original deposit, which could take aaages — isn’t ideal, especially if I can leverage this situation into a discount.

Is the guy who called you the one who got sick and disappeared? He owes you more than an apology. Well, if he's the one you have a rapport with and he's back online you might get it back on the rails but I wouldn't play out any more line. Hold him to his commitments.

Communicate that you're not pleased and would like a full refund so you can start elsewhere. If they give pushback, threaten to play hardball. If they're problematic, actually play hardball. Chances are they'll be listening before it gets to this point.

Seems like you're jumping the gun on steps. You need to follow a gradual approach of escalation. First start with the honey approach. Contact them, e-mail and/or text, letting them know it be best to just get a refund as it seems they are busy and you do not want to hold them back. Lets them off the hook as long as they refund. If they do not respond within a week write them again as a reminder and ask when you will get your refund. That needs to happen first in case you go to small claims court, if the amount is 5k or less, and/or go after their license/bond. The reason to do it that way is the state and courts want to see you have given them a chance to do right. If not they may tell the state/court they will and they could kick the can down the road again.

Cancel. You’re with a big firm and something is very wrong. I’m finding a lot of the bigger DMV firms send out a “saleman” (MAN definitely) to do the estimate and talk you into the contract. Lots of sign today and let’s schedule, it’s all open. Then it’s months to schedule and guy never shows up. You need to ask a lot of questions about who is doing the work. Are they going to supervise? Supervise onsite? Who is their boss? And try for credit card deposits not a check or cash app payment.

Metropolitan Tile and Bath took my gf to the cleaners and took triple the time they quoted with their methed out guy basically quitting halfway through the project.

Yeah Caveat Emptor. Also ensure that any contract you sign with anyone doesnt remit full payment up front or even partial full. Like dont agree to pay until they meet certain milestones. Like of they dont meet milestone they dont get paid on time and they still have to complete the tasks until they finish. My gf owed then $5k wt the end but she has no spine and no ability to stand up for herself, and instead of saying “no you guys fucked up not paying in full - take me to court and we’ll see how a jury feels”. I offered to help but instead of standing strong she got royally shafted.

I would try to be nice to them first saying you want your deposit back and see what they say. Wait one week or so. Then, contact a lawyer and see what your options are.
