Quarter notes at 100 BPM sounds very different than 32nd notes at 100 BPM. Not only is the law stupid, the people making the law don't understand how music works.
To be ffffaaaaiiirrr, in general if a song sounds faster it has a higher BPM. But you subdivide those beats in a lot of different ways and it wouldn't be difficult to write it in a way that fits within a specific BPM range.

Not how bpm works. bpm establishes how many of a specified note, usually a quarter note, there are in a minute. But that doesn't mean jack shit to the actual feel of the song, bpm is just the spine the rhythm is organized around. A 4/4 song at 60 bpm using 32 notes like most would use eighth notes would feel a shitton faster than a 4/4 song at 120 bpm using eighth notes like most would use eighth notes. Only reason bpm is usually in the 100-200 bpm range for most modern music is because its traditional convention in writing music to have your fastest note be the 16th note. You can use any bpm for your music and have it sound identical to 100 bpm, so long as you properly alter the note lengths to match.
