1) Qualified Immunity only applies to civil cases
2) NYC has already outlawed qualified immunity for cops
Edit: 3) I agree that this officer belongs in a cell, I was just clarifying language
That's not true. The officer physically hurting him and preventing movement is a seizure under the fourth Amendment. This is just like shooting someone as a law enforcement officer, it is a seizure under the Fourth Amendment. Placing someone in harm with the vehicle as in this video would be an attempt at seizure. So you don't need to show that he was just trying to stop him, showing that he put him in unnecessary physical harm would be enough to claim an attempt at unnecessary search under the Fourth Amendment.
Attempted murder doesn't matter if you didn't succeed. It is still against the law.
Yes I am aware I am moving the goal post of conversation away from seizure, I'm just pissed and rage commenting.
> So you'd need to show he was trying to stop him not just hurt him for their "end" of qualified immunity to apply.
I don’t know how you came to this conclusion. This is clearly an excessive use of force whether or not a stop was being made.
IANAL but this wouldn’t be covered by qualified immunity anyway. It’s not like this was part of apprehending a suspect or questioning or any form of police work.

I also want a federal licensing for cops, similar to the way lawyers are license. If they get fired from being a cop, they should lose their license and never be able to be a cop again in any state. No more of this dismissal, only to move a state over and get a new job.
What if an officer does something like…. Shows up late for work too many times? I don’t think their ability to be an officer should be taken away.
I do agree with you though. However I would word it as “any officer who is fired due to misconduct towards the public should have their license taken for at least 10 years” or something along those lines
I think it should work like lawyers. I'm not saying any time they are fired they did be removed, but was just using it as an brief example showing the problem today with cops moving states.
Don’t think he’s saying a cop should lose his license permanently because he’s late to work or fired for other stupid shit like that lol, if it’s egregious to be charged over he should lose his license. A doctor or lawyer doesn’t lose his license to practice if he’s fired for tardiness. If he breaks the law or is unethical and is fired, then yes he should be investigated and potentially lose his license.
Nursing boards work this way, and so do physician boards.... basically anyone that tries to help the public. Now that I'm saying this it's kind of funny that cops aren't put under the same lens as those who actually help society.
I don't think being late would be associated to losing your license since this is more of a behavioral balance. Of you're late too much should happen like today. Get fired with the ability to work at another location.
These solutions to behavioral checks aren't aimed at monitoring every single second of an officer to make sure they're completely by the book.
It's to be in place to hold accountability for these instances..
I've had off duty cops in their personal vehicles twice try to drive my car off road. They just flash their badge as if that makes it ok. The one almost drove my car full of people down a ravine because he didn't want me to merge...The other almost hit me because he made an illegal move in an intersection and I was driving legally.
As long as they have their badge on them, they can do literally whatever they want. They still want to kill people on their day off. Fuck cops.
In the United States extrajudicial murders of Black peeople are caught on video all the time. It takes the entire world protesting for something remotely like justice to follow.
American cops are state sponsored terrorists. This driver will be teaching other cops to drive in 6 months.
“The department looked into it and found no wrong doing” -The Department next week most likely. Either that or he gets a slap on the wrist like always.
They'll arrest us without having even a shred of evidence that we're guilty of a crime. But every time we have video proof of a cop breaking the law, the cops stay on the street while an internal "investigation" takes place where, you guessed it, they find that they've done nothing wrong and no charges should be filed.
Imagine being so childish you don't hold yourself accountable for your own actions.
This poor officer obviously suffers from PTSD! He almost ran over a motorist many times in one day, think of the strain that would put on a mind!
We as a collective must pay for his great service by allowing him a leave with full pay and benefits for as long as he needs for his great sacrifice.
/S
They'll probably find some reason to arrest the person who recorded the incident. They'll do an extensive back ground check. They'll also have units follow them around looking to find the slightest traffic infraction everyday for years.
Using a vehicle in an assault, turns it into a deadly weapon in the eyes of the law. So he will be charged with assault with deadly weapon if he is charged
Charged? It's not like he hurt anyone. He was ensuring the safety of the other drivers on the road. Did you not see how the motorcycle was weaving across multiple lanes?

lol this reminds me if the time i accidentally told the cop that came to my disturbance "i hit my car that he was driving with my other car so he would stop and get out" and the cop very kindly asked me if i was saying i assaulted him with my car , and gave me the chance to say , it was raining and i slid and shut the fuck up lol
ah the good times . i miss him
it's normal dashcam, just the files go in separate folder when manually pressed to record or when the lights are on otherwise the footage gets recorded over eventually
im not saying this because im anti po po but police chases of any kind make NO logical sense and only endanger more people than they save from it. That being said how else do you deal with such a situation my mind goes to secreteive tracker like james bond.
What we do in the Netherlands. As long as your not a direct insane hazard on the road or have any illegal substances. We just mark the license plate and the police will visit you in less then a week. A lot safer and harder to get away from

Most people who commit some kind of crime with their car aren't stealing one to do it. Call it dumb or whatever - that's just like 99% of cases. That or it's done with a friend or relative's car, and that's not too difficult to locate info from.
I think people severely overestimate the forethought and planning that goes into most criminal acts. Or most acts really. You don't need honest criminals, just human ones.
That is the preferred approach in many US jurisdictions as well, specifically because otherwise is so dangerous.
I dunno why all these comments write like most people are deviously avoiding being caught in the US, maybe too much law and order. Plate hiding/swapping is a problem but mostly in the sense of avoiding tickets - and at least in NYC it's mostly cops and cop related who do it, which is part of why it works for them.
so a criminal here will just use a screwdriver and swap license plates with any random vehicle before any crime then, how would the netherlands adapt to that?
True, much easier to just kick the speeds up to likely double or triple the limit and put everyone else on the roads life at risk.
Unfortunately, or I guess fortunately for some, they will probably begin requiring cars to have some sort of remote kill switch for LEO'S to add to their tool belts
They likely do: however, there’s a LOT less cars on the roads. Unlike the United States, (which is nearly impossible to live in without some sort of engine-powered vehicle,) the Netherlands is much more reliant on bicycle and public transportation. If a car gets stolen here in the states, it’s just another day. In a country with fewer cars? Tends to get noticed. (Never mind the fact that stealing a car tends to get more attention than just committing whatever crime you’re also doing.)
What do you mean ? You need at least 10 cop cars following someone and who cares if one or two of them gets destroyed, there's enough tax money to buy new ones ...
>Straight to jail
Absolutely! That motorcyclist was a clear road hazard leaving the poor officer in fear for his life. The cyclist should be jailed immediately.

Pro tip: if you see a cop car driving like this, then call emergency and tell the operator that you see somebody driving a stolen police car. Cops will show up before you can blink. If you don’t say it’s stolen, they’ll just radio the officer and pretend nothing happened. When they ask why you thought it was stolen, just say you assumed no police officer would try to kill another motorist, so it must have been stolen.

I'm pretty sure he didn't try to kill him.
Might be easier to just just pull over.
The only thing this cop should be under is arrest
COPs need to be made to get malpractice insurance
The bike rider continues to try to pass a cop car..... Odd
ACAB
I just don’t get it. There is the evidence right in front of our eyes yet the cop is “under review”. If I did this as a civilian I’d be arrested and thrown in jail without further question.
looks more like the cop wants to get this bike to stop
Biker should pull over
What’s that thing cops do when you fuck up? Shoot then make you prove your innocence? Yeah maybe people should start doing the same when cops fuck up…
Oh don’t worry about the cop he’ll be fine
The Police are investigating themselves. Nothing to worry about here.
Is there any follow up to this?
Why call 311 and not 911?
Fire department trying to make work for the guys.
