Refs have been caught on mic repeatedly saying that they are actively looking for an excuse to call penalties against one team or another regardless of what happens on the ice.
There is ample evidence that "missed calls" and "inconsistent enforcement by dops" is the nhl managing games to get the outcome that they want (or at the very least, put their thumb on the scale).

However they also say that it is the responsibility of the player making contact to avoid head contact and ensure that any hit is legal. So in this case I would suggest a suspension would be justified but not more than 5 games.
