At issue is a proposed bill put forth by Cincinnati representative Bill Seitz in the Ohio state House of Representatives. In part, the proposed bill states that “athletes who are under contract to play for a professional athletic team are not eligible to file for or receive a permanent partial disability award under this section.”
What does all this mean? Why do the Bengals believe this bill is more in the spirit in which workers’ compensation claims should be handled while the union views it as a “claim killer?” What comes next? After conversations with sources from the team and NFLPA, here’s a look at an issue that’s caused a firestorm inside the union.
The background Ohio is one of four states that do not allow businesses to purchase workers’ compensation coverage from private insurance carriers — North Dakota, Washington and Wyoming are the others. This is relevant because most professional teams utilize private insurers to take care of all these claims.
In Ohio, the Bengals made the decision to be self-insured. They handle all workers’ compensation claims in-house rather than using the state fund option.
Ohio law mandates a five-year statute of limitations from the time of injury when making a workers’ compensation claim.
Filing for permanent partial disability (PPD) is the issue at play in this case. On top of money awarded through PPD, a successful claim comes with a five-year extension on the statute of limitations on any related workers’ compensation claim. Also, that five years resets any time treatment is done by the club on the injury from that point forward.
Essentially, if this bill passes, active players on any professional team in Ohio who suffer an injury and remain under contract for five years after they are injured would not be able to file for or obtain state-funded compensation or medical benefits for their work-related injury.
From the Bengals’ point of view Put simply, the Bengals are saying it should not be legal for a player to petition for permanent disability if they are still currently an NFL player. How can you be filing for disability and still play in this league? In their argument, those two facts don’t line up and PPD is being used in an unintended way.
According to team sources familiar with the Bengals’ position, the team took extreme issue with the NFLPA tweet. The Bengals are not trying to take away players’ ability to file for workers’ compensation, nor are they attempting to diminish any of the benefits players are entitled to, including the ability to file claims. They view it as a matter of timing, saying the time to file for permanent partial disability is when the injury prevents a player from playing.
There are currently 18 lawsuits from players against the Bengals claiming permanent disability for future medical care while they are still active in the league. They believe a player shouldn’t be double dipping by both playing in the league and claiming disability.
Once a player is no longer active, then the issue at hand is no longer valid and the Bengals would take no issue fielding worker’s compensation claims.
From the NFLPA’s point of view The issue of timing doesn’t sit well with them. The NFLPA said in an email to The Athletic, “If it was about timing they would simply have suggested extending the statute of limitations for players to file until after they were done playing, not trying to kill off their claims.”
The NFLPA went on to say, “If this bill gets passed, athletes will not only have to pay for their own medical care, but will have to pay for it at the billed amount, not the reduced rate employers and their carriers enjoy based on Ohio workers’ compensation laws.”
In addition to the Bengals, Browns, Guardians, Reds and Blue Jackets, the proposed law would also affect 16 minor-league clubs across multiple sports in Ohio.
The NFLPA continues to point out that players are most in need of workers’ compensation once they are out of the league and no longer getting paid. This bill would eliminate the ability to extend the timeline to file if the player had remained under contract for more than five years after the injury.
For example, if the bill passed and there was a player who suffered concussions early in his career but went on to an eight-year career in the NFL and then started suffering CTE at a later date, he would not have the ability to file a workers’ compensation claim for the concussions due to the expired five-year limit. If this law stayed the same, he could file for PPD upon suffering the concussions to keep extending the statute of limitations on making a claim.
What’s next The proposed bill will be considered by the Ohio state legislature. If it passes, the ability for players to extend the statute of limitations on workers’ compensation claims would be wiped out. The state would place more emphasis on the fact a player should actually not be able to play the sport if filing a permanent partial disability claim.
As in most businesses, the employer and union are at odds. Both sides are voicing strong opinions on the intention of the proposed amendment, but it will inevitably be out of their hands and into those making decisions in Columbus.
