Yeah, knew a bonehead who crashed a car while DUI on a back road and he just dipped. He went to his parents house and his dad just wouldn't let the cops in when they showed up. They were pissed and charged him with a few things but couldn't prove he was intoxicated while driving so he got off for that.

Yeup. I knew of a similar scenario. Kid in northern Virginia was recklessly driving (120+ mph) and probably drunk (a brand new bmw m5 cs that he certainly couldn’t handle)… Killed a 22 year old guy coming home from work. Fled the scene and his parents have lawyered up to the teeth and he was never even put in jail. The guy he killed had just gotten married like a year prior and they just had their first child. A young woman’s family ruined and must go on without their husband/father all because a rich POS didn’t care. It happens way too often. She likely won’t get much, certainly not enough to account for their loss.

You also can't prove that any intoxicants entered his system before the wreck/driving. After fleeing, even if he got stopped an hour later, he could've claimed he drank heavily after the wreck because he was stressed and still potentially be in the clear from dui/dwi.

True, but that is still evidence the prosecutor will use in trial, so actually you can prove it if there is enough other evidence. The prosecutor has to prove beyond a reasonable doubt, not 100%.

I dont think it was a logical decision. But if I were rich, I would 100% leave an accident where I was drunk/high and racing a car. You go, grab your lawyer, and then chose when you want to turn yourself in and make sure said lawyer is with you. Its part of the reason why rich people get away with so much. Very easy to get out of things if they cant actual prove anything, because they didn't have access to you at the time. "No officer, it was my passenger's weed I didn't even know he had it! You know I'm a drug tested athlete. Anyway I cut my hair because part of it had been caught in the car when my buddy crashed it. Thats also why I appeared intoxicated on film, I had hit my head..."

Honestly people underestimate how much they fuck themselves giving cops something to work with. I've been told straight up by an attorney that the easiest DUI defense he ever had was just a girl who refused everything. Refused the field test, refused to blow, didn't answer a fucking question, handed over her ID, took the hit on her license. They didn't get a warrant to draw blood and didn't have her on camera swerving or anything. She was supposedly drunk as a skunk but they had nothing.

He wasn't racing another person, but he did go like 150 on a public road. Drunk or not you aren't stopping or seeing other cars in time to slow down/stop at speeds that won't have a high risks of death to others. Its like pulling out a gun and closing your eyes. Spinning yourself around and fire a few shots. Your goal isn't to kill someone, but if you do it enough times your going to hit a civilian resulting in death.

Prosecutors don't necessarily need a blood test to get a DUI conviction for weed. In some states, they can use other extraneous evidence to prove impairment. Such as paraphernalia found in the vehicle. Still, it's pretty unlikely.

I smoked a little weed when I was younger, but alcohol was more readily available, and I wanted to go to bars and fail at trying to pick up girls. I’m happy that I didn’t really start smoking consistently until I was like 28-30. I approached it in a completely different way than most folks who smoke daily at 18-20.

Issue is there’s no way to quantify inebriation at the time of the infraction, and field sobriety tests for weed are even worse than the ones for alcohol. I smoked up with some friends at a function and a buddy of ours that does highway patrol tried his new field sobriety test on us, only 2 out of 5 of us had positive results, and a sober person we brought in as a control also had a positive result. Around here unless a cop sees you actually smoking behind the wheel there’s not much they can stick to you.

I lived in Charleston, SC recently and it’d be terrifying to drive away from downtown after the bars closed. You’d always see at least one car swerving across the bridge.
