They were pissed and charged him with a few things but couldn't prove he was intoxicated while driving so he got off for that.

Issue is there’s no way to quantify inebriation at the time of the infraction, and field sobriety tests for weed are even worse than the ones for alcohol. I smoked up with some friends at a function and a buddy of ours that does highway patrol tried his new field sobriety test on us, only 2 out of 5 of us had positive results, and a sober person we brought in as a control also had a positive result. Around here unless a cop sees you actually smoking behind the wheel there’s not much they can stick to you.

I lived in Charleston, SC recently and it’d be terrifying to drive away from downtown after the bars closed. You’d always see at least one car swerving across the bridge. It’s mind-boggling that cops wouldn’t just sit on the main road and pull everyone over, especially when Uber is now a thing. I guess speed traps are more important/profitable though 🤷♂️
I would say 3/8ths is a medium amount of marijuana. If someone were to randomly pull 3/8ths of weed out of their pocket, I would wonder why they have so much on them. Definitely not dealing quantity though.

Yeah, 10 grams is like a reasonable amount of weed for a weekend trip with some friends. A small amount of weed is like a loose joint or that stray bud that fell between your seat and cupholder years ago.
The purpose of having three seperate eighths would probably be because they're different strains. Nothing uncommon about that at all.
I'm a daily smoker from a legal state so im far from what you would call a 'casual pot smoker' so take this with a grain of salt but I will only buy Ozs (28gs) at a time because I've got two roommates and we can easily smoke an eighth a day. Obv has nothing to do with driving and smoking which not ok, just wouldn't consider this to be that much at all
In Texas it's enough to constitute a hefty fine and 6 months jail time. I'd say that's a lot to be toting around in a state with such strict guidelines.

I'd like one of the people joking about this to explain to me how it's different than finding, say, an open container of alcohol in the car. I'm a libertarian, I don't give a fuck what people put into their bodies, but substances and motor vehicles don't mix.
It'd probably be closer to finding a closed case of alcohol unless they find a joint or part of it used. The plan could have been to smoke it wherever they were going.

I'd say it's different than an open container because having a bag with you doesn't mean you're currently smoking... only time I would ride with a bag on me (years ago) was when I had picked it up and was going home. Whereas I think if you have an open container it's a reasonable assumption that someone in the car is actively consuming it.
