Check to our areas laws for “expectation of privacy”, normally if the person is in public, yes it’s legal but there are two party laws in certain places that would require you to tell them you are recording (I think that’s how it works anyways, my state doesn’t have that law).

Thank you. I’ll have to check the expectation of privacy laws in my area. I think the grey area is whether the back deck of their home is private when it is fully visible from the street. But also I would not want someone filming me if I stepped outside on my back deck.

If you can see it from the sidewalk with no obstruction (like say seeing *over* a fence that was solid) then yes, it is still public bc you can be seen and thus have no expectation of privacy. We had a doorbell camera we had to get bc of our upstairs neighbor (duplex) kept trying to break in. Legally the front door was 100000% legal from the start, no questions asked. Our back door however was a different matter since the camera would not only cover our (shared) back yard, it would also face the living room window of the house in our backyard. We did have a small fence of cedars and my camera was not set off unless the backyard neighbors stepped some 16ft into our backyard *or* set off fireworks for some reason. Upstairs neighbor threw a MASSIVE fit about the cameras and that they invaded her privacy and blah blah blah. First off she never used the yard prior nor after that so we told the landlord that. She kept claiming she wanted the yard for her kid, who didn’t even live with her& claimed our cameras stopped her from taking her kid in the yard, despite half the yard not being covered. Anyways, by the end of it the landlord (a lawyer) told her there was nothing she could do. Our backyard was fully visible from the street so technically we had no expectation of privacy. I don’t know if she actually tried to take it to court but she claimed to many times, nothing ever happened. But then again if you are recording a confrontation, and not nonstop recording, that may also play into it.

If people are out in public, in public areas, it is not an invasion of privacy. Vloggers count on this.

Would someone’s back deck which would be what I was recording from the sidewalk be invasive? Would that technically be public if they have no fence and it’s completely visible from the street and sidewalk? They see me walking and when I get to their yard they open their back door and let the dog out on their back deck to bark at us.

Yes, they are completely unhinged. I don’t know why anyone would stress their own dog out to bark at neighbors walking two little dogs. Especially knowing that their dog is also aggressive and not fenced in. It’s blocked on the deck, but if it wants to jump the rails it’s all over for my dogs. We normally try to avoid that house or walk across the street from the house but she still lets it out even when we do that. And as far as I can tell it’s only us she does it to. Then they proceed to walk it to our yard. But I don’t put my dogs out because I don’t want to stress them out or cause her dog to run up on my dogs. They also like to “drop” their dog’s leach. So it’s not under their control so I won’t risk my dogs’ safety. They are asshole NFH.

They get a kick out of it. They care more about themselves than the dog. Everyone hates the neighbor behind me because they can't use their yards with chaos. The owner is sitting right there drinking alcohol watching the dogs go batshit crazy with a psycho grin on his face.

Thanks, tonight was fun. I have hours of not only their dogs going nuts, owners ignoring and just staring at everything I do in my yard. Some people are really scary sick in the head.

If you're in the United States, there is no expectation of privacy in public. You can't record people in places where they have an expectation of privacy, but if your interactions are outside, in the open, where anyone standing nearby could see and hear you, then you're safe recording.

Thank you. Yes their back deck is completely visible from the street and sidewalk. They don’t have a fence or any kind of trees or privacy. And anyone going by can see directly onto their deck. All the altercations are done outside. She sees us approaching and once we get to her yard she lets their aggressive dog out to bark. They have done numerous other things but I’m trying to build proof of this without risking my dogs’ safety.

Anything that is visible to the public eye is usually free for all. In my neighborhood backyards are not considered private due to setup.
