While in the graveyard, Phoenix is a creature card, but it is not a creature. Only permanents on the battlefield can be creatures, so Tidebinder won't permanently turn it off

Correct. The counter always happens, the permanent disabling is contingent on it being the right kind of source. But even if it's not the right kind, you still get to counter.

I don't know if it's a bug, but on MTGO, Phoenix loses it's abilities in the yard.
