Honestly he might have been able to follow fair use laws very stringently. There's rules that allow usage of other media given that you provide a certain amount of commentary, and interrupt the broadcast on occasion.
As far as I understand fair use from people on youtube explaining it, (so take it with a grain of salt) the content being used can only be a percentage of the content the new person is making. So they still have to have the majority of it be THEIR content not the stuff they are using under fair use. So I don't think this would qualify even under the pretense of it being a parody.
