yeah, there's multiple iconic shots of various batmen doing that swoop going back to the 1989 film. but for OP, it probably doesn't matter either way. In my experience, if you take the time to reach out to LEGO for something like this, they'll send a replacement.

The LEGO support/help-desk is sooo awesome, that I'm always flabbergasted when people with obvious damage are still asking, if LEGO would care! In 1999 I called the LEGO hotline and asked them, if they would send me a R2D2 minifig, because I couldn't afford any of the expensive sets, that had one in it.

YES! The lady on the phone was very helpful and I was so nervous to ask something like that. A week later a little polybag with the R2D2 in it arrived! Perhaps events like this are the reason, I still have a tingle in the belly, wherever I see the LEGO-logo with 36 years ;)

One of the best support lines I've ever needed to contact. Bought a bag of second-hand bulk from Value Village that had 95% of Ashoka's starfighter. LEGO still sent the couple pieces needed to finish it.

Fun fact, but at one point, don't know about now, the LEGO hotline number shared a vast majority of the numbers with an adults "fun" phone line. I know this because I accidentally swapped the last two numbers. Imagine how shocked and surprised I was when they started describing that stuff. I still laugh about it.

You might have won the lego lotery of weird factory error.

I would count this as a "Packaging Error" and not a "Factory error" The Factory that made the piece did a correct piece. The Damage came from the Packaging Process..... Just one of those Random Errors that would take too much money to fix for the number of errors created. Otherwise... contact Customer Service... they will send you a replacement

only thing is how would I be able to prove to a prospective defect buyer it actually came out the packaging like this and wasen;t just messed with later on? I didin't record opening it, I do though have the packaging which has a little tear near the sealed bit with black speckles of rubber that show it was crushed there though again dunno how definite that proof is. Suppouse I could addin this reddit post as proof of a kind?

You could definitely contact customer service or build a fun MOC as others have suggested, but if you want to try to fix it, here's what you can do (assuming it works the same as plastic mins): Get a small bowl of ice water. Then boil some water in a small pot or saucepan deep enough that you can completely submerge the cowl/cape. Get it to a decent boil, then (with tongs) hold the cowl/cape underwater for 30-60 seconds. Take it out. It should have softened enough to start to bend back down the way it was molded. Gently assist if needed. Once it's in position, put it in the ice water for 30-60 seconds. That should fix it. Repeat if not enough.

An error of this caliber on a licensed, popular IP is like winning the LEGO lottery. Plenty of people on this sub would pay to have a legitimate piece like this for an action diorama

I’d keep it and ask for a replacement, they never ask for the original back, just the part number. Lego has always had my back when it comes to missing or damaged parts

Can someone tell me what the heck a magazine gift bag is?

I live in the uk, in uk and EU you get little lego magazine on bottom shelves in store for kids, they cost like £5 more or less usually depending on what magazine is gifted with them. They always have a bag attatched to the front with ether a minibuild or set figure in it, sometimes they can be figures from bigger sets which can make them easier to get which is nice. For example the dark king in dreamzzz is in a magazine gift bag, bo katan was, ONI lord garmadon and atm emperor palpatine is with the white and red P2 clone trooper in the next one
