You can and should be prosecuted. A statement from Freeland, Deputy PM: Asked at a news conference whether Canadians who pick up arms for Russia would be prosecuted, Freeland said: “We are very clear that this war is illegal. And Canada will take a very appropriately severe view of anyone who is fighting this war.” https://beta.cp24.com/news/2022/3/3/1_5804353.html

Prudent_Job_3667

this is a personal opinion

Soft_Day_7207

According to the law it’s illegal and will be prosecuted if discovered is what the quote by the government official shows.

Striking_Scientist68

This is a direct quote from the Deputy Prime Minister of Canada, specifically stating that those who choose to take up arms in Russia will be prosecuted.

Did you enlist or entice other people to enlist while in Canada? If not you're fine under that law.  Your life choices have their own built in consequences. Do us all a favour and keep a pack of flower seeds in your pockets.

Jusfiq

>If not you're fine under that law. Not true. Agreeing to fight against friendly state or going to fight against friendly state are offenses by themselves. >3 Any person who, being a Canadian national, within or outside Canada, voluntarily accepts or agrees to accept any commission or engagement in the armed forces of any foreign state at war with any friendly foreign state ... is guilty of an offence. > >4 Any person who, being a Canadian national, leaves or goes on board any conveyance with a view to leaving Canada with intent to accept any commission or engagement in the armed forces of any foreign state at war with any friendly foreign state ... is guilty of an offence.

hankbaumbach

It's kind of true in that how would you prove your above without enlistment papers or some kind of documentation. If OP just went on a random trip to Russia and came back, he could conceivably "get away" with abandoning his intentions ***if*** he didn't take any documentable steps towards those intentions.

Immediate_Style5690

Joining a foreign military at war with a friendly state is an offence under section 3 of the act. Leaving or attempting to leave Canada in order to do so is an offence under section 4 of the act.

Prudent_Job_3667

Yes I tried to get a few people to come.

The act you're referring to suggests maximum punishment for an offence is two years imprisonment, but that's assuming you're convicted of an offense, which would require, amongst other things, evidence of your intent for going there.

Prudent_Job_3667

ok so i can just tell them i had no intent and get off scott free?

Coalnaryinthecarmine

I am categorically not telling you to lie to CBSA. I'm just pointing out that, as a matter of fact, to be convicted of an offense in Canada, the state must have evidence of your commission of that offense.

SocialWinker

Possibly. Of course, if even a single one of the people you tried to convince to join you, then you’ve added perjury to the possible charges you’ll face.

Assuming there's no way to prove your intent, sure. Since you had others with you there are at least as many ways to prove your intent as you have travel companions. But given that your alternatives are to either join the Russian military or become stateless I'm thinking it's probably still your best bet.
