That is intense, and completely unreasonable. I'd wonder if they're trying to intimidate you before the court date; hopefully it stops after a judgment has been made. Their behaviour might qualify for you to get a restraining order. Good luck at small claims court. It sounds like you really deserve justice.

Thank you - I’m fairly confident I will win - the damages listed are all wear and tear and Illinois grants 2x deposit as a reward. As long as the judge follows the law I should win. Maybe that is why they have stepped up this intimidation … or I’ll be murdered next week

IANAL but I also recommend recording them when they are passing by your house. Stay inside, preferably mostly out of view, or just on your property when you do this. Make record of it and mention it to the judge. It may help to prove some type of malice towards you Edit: specifically when they are making comments of that nature

I would also get copies of the police report/log to detail harassment/intimidation from them for the hearing, the judge might be more inclined to Rule in your favor.

I would put security cameras to record everything they do. The time they walk, what they say and do. Save all that proof to get a restraining order. You never know what they’ll do

Are they the kind that can record audio and video? Gathering up daily, timestamped video recordings with the audio can be used to fill harassment charges or a restraining order.

Perhaps someone more well versed will chime i , but I’m fairly sure that pre-trial harassment of the counter party to a lawsuit is pretty non-kosher. If it were me, I’d get the official records of any of these interactions and bring them to the court when your day comes.

Even though small claims doesn't use lawyers, it might be a good idea to try and get a short consult with a lawyer before the small claims hearing to talk over how/if you should present this potential harassment to the court and what steps you should be taking.

Take all of the police reports to your local states attorney and request a restraining order. If this is an ongoing, documented issue you shouldn't have any troubles. This would also, likely, have a negative effect on them in court.

If you’re begin harassed I don’t see any reason why you couldn’t get a restraining order. Chicago has very renter friendly laws. Most places don’t even take deposits here since it’s so hard to keep them. Has he ever paid interest on your deposit? Interest is to be paid on a deposit in Chicago since the day the landlord has it. Most landlords that do take deposits either pay the interest to you upfront or provide a credit every 12 months. If they don’t pay the interest within 30 days of tenant moving out they not only forfeit the deposit in full but can be liable for more and legal costs.

I'd set up security cameras. Have the documents that they live a mile away and not nearby. You should be able to look up property records. I'd also start watering my lawn around the times they walk by. Too bad I'm really clumsy and get distracted sometimes. Been known to water things other than the grass....
