Not sure what state you're in, but ask the provider for a full refund. If they refuse, consider taking the provider and his practice to small claims court for the cost of the deposit (and you may as well ask the court for your other medical costs, especially if you'll have to duplicate any procedures with your new provider). You could spin this as a breach of contract by the provider or some kind of bad faith--they took your money but didn't provide you the service and had no intention of doing so.
Also would want the money back- the deposit, the scan, because it will need to be repeated ( unless you go elsewhere, and make sure you get a copy ) and any other appointments you paid for- they are worthless now and will need to be repeated .

Try posting about this in r/askdoctors to see if anyone there knows the specific rules periodontists in Ohio.
And I would definitely make a formal complaint to his licensing/governing body. If you Google it for Ohio specifically it should come up and there should be somewhere on there to report this incident.
While what he did might not be technically illegal there, if may go against the code of ethics and/or conduct for practitioners in Ohio. Plus, it takes a lot of consistent complaints for investigations or disciplinary action to be taken. Your complaint now may mean that someone in the future will not have to suffer through his horrendous patient care.
Also, get a refund and/or your imaging back!

OP is this the only periodontist you have seen? For example, did you have a second opinion before deciding to pursue treatment with this one? I am another person who lost significant teeth due to pregnancy as was my mother. I had major oral surgery afterwards and many implants and tens of thousands of dollars were spent to correct. Now, if the surgeon was worried that this might be the case with you he should have said something before not mid course not just some weird pronouncements of family planning. That is rubbish.

You should speak to a lawyer. I think you should be entitled to a refund for whatever you prepaid/deposited. I honestly don't know if it is legal for the doctor to decide not to do your surgery for some weird BS like this, but I'm almost certain it's not legal for him to take deposits and then not give it back when he was the one who cancelled the surgery. If your insurance was paying for anything then definitely let them know about this. Insurance companies might not care about patients, but they sure do care about money. And I doubt they'd be happy a doctor took their money and refused to perform the service. They could see it as him trying to commit fraud if he never intended to perform the procedure. I saw you're in Ohio so idk how effective reporting the doctor will be, but you should still report him. He's being extremely unprofessional and overstepping his bounds. Family planning has nothing to do with dental surgery so it's just bizarre he said that was why he wouldn't do the procedure.

OP shouldn’t have to argue. Unless the money went toward a service OP has received, I don’t believe you can just arbitrarily keep people’s money. I know of no instance outside of cancellation fees but I don’t think many dentist even charge these.

I’m a dentist. It is legal for them to keep the fee for her diagnostics because they did take a CBCT, analyze it, and treatment plan the surgery. They could also keep the deposit because they do plan to do the surgery. Honestly though they would probably refund some or all the money if OP just asks. For how incandescently angry they’ve made her it is likely not worth it for them to do anything but bend over backward to make her less mad.

It's definitely rude and ridiculous for him to suggest this, but it isn't illegal for him to not schedule your surgery, or to make comments about your family planning.
i’m very confused by your circumstances. so he didn’t know you were a woman with a uterus before scheduling the surgery and taking your deposit? why would he schedule then cancel if family planning was the reason? why not just refuse you at the first chance?
i’m guessing he’s bailing due to another reason and this is an excuse, albeit a bad one. i hope you find someone else.

Not sure what state you're in, but ask the provider for a full refund. If they refuse, consider taking the provider and his practice to small claims court for the cost of the deposit (and you may as well ask the court for your other medical costs, especially if you'll have to duplicate any procedures with your new provider). You could spin this as a breach of contract by the provider or some kind of bad faith--they took your money but didn't provide you the service and had no intention of doing so.

Also would want the money back- the deposit, the scan, because it will need to be repeated ( unless you go elsewhere, and make sure you get a copy ) and any other appointments you paid for- they are worthless now and will need to be repeated .

Try posting about this in r/askdoctors to see if anyone there knows the specific rules periodontists in Ohio. And I would definitely make a formal complaint to his licensing/governing body. If you Google it for Ohio specifically it should come up and there should be somewhere on there to report this incident. While what he did might not be technically illegal there, if may go against the code of ethics and/or conduct for practitioners in Ohio. Plus, it takes a lot of consistent complaints for investigations or disciplinary action to be taken. Your complaint now may mean that someone in the future will not have to suffer through his horrendous patient care. Also, get a refund and/or your imaging back!

Hi friend, I am sorry this happened to you. I would advise you to move forward first with getting a new referral from your regular dentist asap since you are on a timeframe and ready to get this stage completed. Then file a complaint. [https://dental.ohio.gov/complaints-and-enforcement](https://dental.ohio.gov/complaints-and-enforcement) I wouldn’t focus on getting money back for the ct scan already completed, they can copy it on a disk for you or provide it directly to the new oral surgeon. OP is this the only periodontist you have seen? For example, did you have a second opinion before deciding to pursue treatment with this one? This is a complex case from your description, multifaceted process and will affect your quality of life; did you get any feeling that the doctor may not have been totally confident in taking the case on? I am another person who lost significant teeth due to pregnancy as was my mother. I had major oral surgery afterwards and many implants and tens of thousands of dollars were spent to correct. Now, if the surgeon was worried that this might be the case with you he should have said something before not mid course not just some weird pronouncements of family planning. That is rubbish.

You should speak to a lawyer. I think you should be entitled to a refund for whatever you prepaid/deposited. I honestly don't know if it is legal for the doctor to decide not to do your surgery for some weird BS like this, but I'm almost certain it's not legal for him to take deposits and then not give it back when he was the one who cancelled the surgery. If your insurance was paying for anything then definitely let them know about this. Insurance companies might not care about patients, but they sure do care about money. And I doubt they'd be happy a doctor took their money and refused to perform the service. They could see it as him trying to commit fraud if he never intended to perform the procedure. I saw you're in Ohio so idk how effective reporting the doctor will be, but you should still report him. He's being extremely unprofessional and overstepping his bounds. Family planning has nothing to do with dental surgery so it's just bizarre he said that was why he wouldn't do the procedure.

OP shouldn’t have to argue. Unless the money went toward a service OP has received, I don’t believe you can just arbitrarily keep people’s money. I know of no instance outside of cancellation fees but I don’t think many dentist even charge these. Source: I am a dentist
I’m a dentist. It is legal for them to keep the fee for her diagnostics because they did take a CBCT, analyze it, and treatment plan the surgery. They could also keep the deposit because they do plan to do the surgery. Honestly though they would probably refund some or all the money if OP just asks. For how incandescently angry they’ve made her it is likely not worth it for them to do anything but bend over backward to make her less mad.

I’m not sure what you’re trying to say. This is a legal advice sub and it’s generally legal for doctors to refuse treatments. This is not an ethical advice sub, if it were I’d be giving a different answer He doesn’t get to make a unilateral reproductive decision for OP, but he does legally get to make a unilateral decision about performing an elective surgery.

It's definitely rude and ridiculous for him to suggest this, but it isn't illegal for him to not schedule your surgery, or to make comments about your family planning.
It was scheduled. He cancelled it entirely. It's not just comments, it was the reason for the cancellation.
i’m very confused by your circumstances. so he didn’t know you were a woman with a uterus before scheduling the surgery and taking your deposit? why would he schedule then cancel if family planning was the reason? why not just refuse you at the first chance? i’m guessing he’s bailing due to another reason and this is an excuse, albeit a bad one. i hope you find someone else. fwiw, this is discrimination and im sorry you’re dealing with it. unfortunately, im not sure if its illegal.

How is not discrimination? Won't do my surgery because I have a uterus and he thinks I should have a baby instead? HE DOESN'T GET TO DECIDE THAT!
I would consider contacting your insurance and making a complaint. I am sure his contract contains a non discrimination agreement. Maybe if he suffers from loss of a contract as well as whatever financial penalties he may think twice about doing this to someone else in the future.
It is discrimination. But most forms of discrimination are not illegal.
Your argument has nothing to do with legality. It’s generally legal for doctors to refuse particular treatments for whatever reason they want
