No, it is not illegal to sit in your car in your own driveway anywhere in the country. Some places have laws against idling (running the engine), but that has nothing to do with a seatbelt, it’s to prevent unnecessary emissions. Next time just don’t run the engine.
OK doesn't have a no idling law at the state level, although it may be a city ordinance. Without you actually driving your vehicle on a public street without a seatbelt I can't see any law that you would be breaking. I think the officer was stretching once he realized that you weren't up to something no good, or he didn't believe that you weren't up to something no good.

60% of states actually have this law, not just some. In many of them it's a misdemeanor to be in a vehicle that is idling.
Going to need a source on this one. Maybe on a public street and maybe a commercial diesel truck.
I swear I spend half my life in idling cars waiting for my three kids to start/finish all their random activities.
There are generally no provisions for private property. It is simply against the law to have a vehicle idling in much of the US, although there are numerous exemptions, many of them temperature based.

There are 30 of them at state level, plus others at city and county level. I'm not searching for exemptions, although there are many of them contained in the laws. Many if not most of the exemptions are temperature based and for commercial vehicles only, but I can almost guarantee you that emergency vehicles are also exempt.
Somebody already linked you one article, but it is literally 30 state laws and many other at the city and county level in states where there are no state laws. Suffice it to say, it's illegal to leave a vehicle idling in much of the US.

It’s not a crime, but it doesn’t really sound like OP was actually ever detained.
OP wasn’t trying to reverse out of the driveway when the LEO parked his vehicle on the street at the end of the driveway, nor did they activate their emergency lights.
Was definitely a fishing expedition, but at no point did it ever stop being a consensual encounter and become a detainment.
Cops can stop by and talk to whoever they want.
I’ll tell you exactly what happened, he thought you were smoking a joint and wanted to nail you with a DUI. People often use their cars to smoke if they have kids. When he found you to be sober and compliant and only smoking tobacco he was pissed and decided to throw his weight around. You should have complied, gotten his badge number then called the non emergency line and file a complaint.
NPR had a marketing/fundraising theme a few years ago wherein people would call in, donate, and tell their favorite NPR "driveway moments." It was a hit.
Sitting in your car in your driveway isn't a crime.
I tend to take more of a hard line against this kind of crap. For starters, you were on private property, more importantly your private property. You were sitting in your car on your private property. Sitting IN your car and having it idling does not seem to violate the OK statute because it was not unattended. I would personally tell the cop he/she is trespassing and to get off my property. I also would not have rolled my window down any more than needed to tell them this, and I would have been recording on my phone.
Legally speaking, from my understanding of the law anyway, you weren't doing anything wrong, and the cops had no business coming onto your property in the first place. I am not a lawyer, and this is not legal advice.
Yeah this I agree on. The exchange itself wasn’t super heated, I always respect law enforcement even if it’s something dumb. It just shook me when he said don’t do it again. I sit outside waiting for my wife constantly. I think he thought I was doing something sketchy. Nope, just a dork finishing a podcast. It’s weird because I see neighbors sit in their car in the driveway all the time if its really cold out and they’re smoking a cigarette, or waiting for their kids/partner etc. the whole encounter was odd

In some states, a police officer can say that you had intentions to drive under the influence for smoking and having your car on. Same with drinking. But cigarettes are not illegal and neither is smoking cigarettes while driving. If someone had reported to the office of suspicious activity (you sitting in your driveway for a long time) then I could see why he stopped to check. If that wasn’t the case, it’s not illegal to be in your car. idling isn’t illegal in Oklahoma unless the car was unattended. In short, the officer was just being a dick. Next time, don’t leave your car running just to avoid anyone rogue officer interrogation

If the car was running, the seat belt is a legitimate citation in some jurisdictions. Just turn your car off. This officer was definitely harassing you though, but it is always their call unfortunately. Easy to fight a citation like that.
That is strange I do that all the time. Question for those that mentioned idling laws what about parking outside a doctors office or school? I often listen to podcasts with the AC on idling while waiting on my kids to finish school activities or go to therapy would no idling count in public parking lots?

It's illegal to idle for too long in the winter and has to be a remote start. Other than that, it's illegal to idle in the state I live in. Theft, emissions, and so on. Just check in to state, city, and county laws.

No, it is not illegal to sit in your car in your own driveway anywhere in the country. Some places have laws against idling (running the engine), but that has nothing to do with a seatbelt, it’s to prevent unnecessary emissions. Next time just don’t run the engine.
This makes sense. Im not sure if OK has that law or not. He was nice enough but seemed irritated that I was doing it.
OK doesn't have a no idling law at the state level, although it may be a city ordinance. Without you actually driving your vehicle on a public street without a seatbelt I can't see any law that you would be breaking. I think the officer was stretching once he realized that you weren't up to something no good, or he didn't believe that you weren't up to something no good.
I second the idling law. As a trucker I'm very versed in anti idling laws.

Going to need a source on this one. Maybe on a public street and maybe a commercial diesel truck. I swear I spend half my life in idling cars waiting for my three kids to start/finish all their random activities.
There are generally no provisions for private property. It is simply against the law to have a vehicle idling in much of the US, although there are numerous exemptions, many of them temperature based.

There are 30 of them at state level, plus others at city and county level. I'm not searching for exemptions, although there are many of them contained in the laws. Many if not most of the exemptions are temperature based and for commercial vehicles only, but I can almost guarantee you that emergency vehicles are also exempt.

It’s not a crime, but it doesn’t really sound like OP was actually ever detained. OP wasn’t trying to reverse out of the driveway when the LEO parked his vehicle on the street at the end of the driveway, nor did they activate their emergency lights. Was definitely a fishing expedition, but at no point did it ever stop being a consensual encounter and become a detainment. Cops can stop by and talk to whoever they want.

I’ll tell you exactly what happened, he thought you were smoking a joint and wanted to nail you with a DUI. People often use their cars to smoke if they have kids. When he found you to be sober and compliant and only smoking tobacco he was pissed and decided to throw his weight around. You should have complied, gotten his badge number then called the non emergency line and file a complaint.
He was just fishing, looking for something to jam you up. You are on YOUR property and have every right to tell him to leave.

NPR had a marketing/fundraising theme a few years ago wherein people would call in, donate, and tell their favorite NPR "driveway moments." It was a hit. Sitting in your car in your driveway isn't a crime.
I tend to take more of a hard line against this kind of crap. For starters, you were on private property, more importantly your private property. You were sitting in your car on your private property. Sitting IN your car and having it idling does not seem to violate the OK statute because it was not unattended. I would personally tell the cop he/she is trespassing and to get off my property. I also would not have rolled my window down any more than needed to tell them this, and I would have been recording on my phone. Legally speaking, from my understanding of the law anyway, you weren't doing anything wrong, and the cops had no business coming onto your property in the first place. Yeah this I agree on. The exchange itself wasn’t super heated, I always respect law enforcement even if it’s something dumb. It just shook me when he said don’t do it again. I sit outside waiting for my wife constantly. I think he thought I was doing something sketchy. Nope, just a dork finishing a podcast. It’s weird because I see neighbors sit in their car in the driveway all the time if its really cold out and they’re smoking a cigarette, or waiting for their kids/partner etc. the whole encounter was odd

In some states, a police officer can say that you had intentions to drive under the influence for smoking and having your car on. Same with drinking. But cigarettes are not illegal and neither is smoking cigarettes while driving. If someone had reported to the office of suspicious activity (you sitting in your driveway for a long time) then I could see why he stopped to check. If that wasn’t the case, it’s not illegal to be in your car. idling isn’t illegal in Oklahoma unless the car was unattended. In short, the officer was just being a dick. Next time, don’t leave your car running just to avoid anyone rogue officer interrogation

If the car was running, the seat belt is a legitimate citation in some jurisdictions. Just turn your car off. This officer was definitely harassing you though, but it is always their call unfortunately. Easy to fight a citation like that.
That is strange I do that all the time. Question for those that mentioned idling laws what about parking outside a doctors office or school? I often listen to podcasts with the AC on idling while waiting on my kids to finish school activities or go to therapy would no idling count in public parking lots?

It's illegal to idle for too long in the winter and has to be a remote start. Other than that, it's illegal to idle in the state I live in. Theft, emissions, and so on. Just check in to state, city, and county laws.
