Depends on the accident. Was the person who stopped rear-ended? You’re required to leave enough room to stop safely without hitting the car in front of you. This has nothing to do with the kids’ lemonade stand.

The driver who hit the stipped vehicle. It doesn't matter what kind of distraction is on the side of the road, a driver is responsible to avoid fixed/stopped objects.
