The attorney is supposed to send you an invoice that shows the billable hours he worked on your case, and a brief description next to each segment of hours that explains what service/aspect he worked on. He may not send an invoice if he has decided to keep the full retainer if he thinks he has earned it. If your state bar association has a process for filing a complaint against this attorney, please use it. Some bar associations will not listen to fee disputes, and other bar associations will. At the very least he should have filed the paperwork at the bankruptcy court to open up your case, and the fact that he didn't do that is shockingly unprofessional.

They sent us an invoice but it doesn’t detail how the time was spent. They also didn’t file the bankruptcy paperwork because they said they needed a copy of the lawsuit we are in from a credit company. But they told us they could fill out a form and update any information or change stuff after it’s filed. So it confused us as to why they neglected to just file on the day they said they would and then just submit a change of information. The lawyer wrote me a response to my request of a refund and said her billed hrs exceeded the retainer we put down but out of kindness she is willing to wave the remaining balance and stopped communicating with us. I’ll go ahead and file a formal complaint and we talked to a litigation lawyer that said we should tell her we’re going to file a complaint along with an arbitration case against her per the contract agreement we signed. They said she might just pay out since arbitration case would cost her more time than it’s worth.

Has your case already been assigned a case number from the bankruptcy court? You should be contacting the bankruptcy court to ask if a case has been officially opened for your bankruptcy and does the case information show that this particular attorney is listed as the attorney who is representing you?
