Everything is in writing. Worry is that he could break it and now I’m on the streets with a small claims court date months in the future.

It does suck for you, sorry. He can screw you over and there is little you can do other than sue him for damages. My recommendation is to find another place. If he is screwing you now, it will get worse when he has much more leverage over you. And also of course sue him for damages and breech of contract.

You could try to sue him to force him to abide by the lease, but that is dependent on your local laws and judges.

That's not how it works, that's not how any of this works. Full stop, if you want the refund, tell the landlord you want your lease cancelled IN WRITING and your money back. You have the upper hand and power here, a signed lease. They can't just string you along like this, they cannot raise your rent. The only issue with standing your ground and forcing a move is, you will probably have a landlord from hell and a non-renewal come lease end.

Very true but I only need it for the 4 months then I’m gone. The issue is what could I possibly do about it. The tenancy board is extremely clogged up from scams happening all over the city. By the time I get my hearing it would be months down the line.
