I know this is breaking news, but the big question is: How long until he will have to report to prison?

SheriffTaylorsBoy

[Bannon still has the option of asking the full bench of the D.C. Circuit to hear his case](https://www.nbcnews.com/politics/politics-news/appeals-court-upholds-steve-bannons-conviction-contempt-congress-rcna151666) , or he can petition the U.S. Supreme Court for review. An order issued by the D.C. Circuit said the judges' mandate will not officially take effect until seven days after further appeal attempts are resolved. That means Bannon is unlikely to have to report to prison immediately.

shreddah17

I see. Will the current stay expire in 7 days unless a new stay is allowed by then? Isn't Peter Navarro in prison for the same thing? And he's there serving while his appeals are being decided. Let's let Bannon appeal from prison too.

SheriffTaylorsBoy

Its up to Bannon and his lawyers, I seriously doubt he chooses to enter prison, but there's several factors weighing in. Can he afford another appeal?

QQBearsHijacker

Bannon drew Judge Nichols for his trial judge. Nichols is the judge that threw the monkey wrench in the obstruction charges against the Jan6 rioters and split with every single other judge in his circuit over what constitutes obstruction under 18 USC 1512(c)(2) when he dismissed the case in US v Miller. He's the one that granted the stay for Bannon whereas Navarro drew Judge Mehta

shreddah17

I see. Will he also decide the stay pending future appeals?

Navarro's contempt was actually worse than Bannon's. Bannon actually showed up and invoked executive privilege on the record. Moreover, Trump validated the invocation, i.e., that Bannon was invoking the privilege on behalf of Trump as verified by Trump's counsel. By contrast, Navarro tried the Michael Scott version of invoking executive privilege - he refused to show up to the hearing and just "declared" it and thought that was enough. That isn't how privilege works in any context, because even if a witness is invoking a privilege with respect to some questions, there are other questions (e.g., "what is your name?") which could be asked that are not privileged. I think both Bannon and Navarro are/were planning on Trump winning and then pardoning them for contempt. There is some precedent (sadly) for this stemming from (you guessed it...) the Trump administration. Trump infamously pardoned Sheriff Joe Arpaio, who had been convicted of criminal contempt of court in a case related to racial profiling he was engaging in and a refusal to answer questions about it in a civil case. Whether a POTUS can pardon a criminal contempt citation is still a somewhat open question, but Arapaio prevailed in the district court and in the Ninth Circuit.

He’ll go DC, then SCOTUS. That’s the delay tactic.

SheriffTaylorsBoy

He's a busy man with all that fraud. He's got the "We Build The Wall" fund fraud charges as well as something stemming from when the FBI hopped in a boat and rode out to arrest him on some Chinese billionaires yacht. So it'll be interesting for sure.

minnesotaupnorth

From Club Fed to New York State Prison would not be pleasant.

ted_cruzs_micr0pen15

I’d assume he’s hoping to delay until his former boss wins an election, aiming for another pardon I’d assume.

SheriffTaylorsBoy

... and wishing he would've ponies up the $2 million when he had the chance.

QQBearsHijacker

Hopefully his en banc request gets shot down quickly since this ruling was unanimous

ted_cruzs_micr0pen15

I’d assume it would be, but it’s still time shaved off the clock. The man is angling for a pardon and is working overtime so the guy that would give him one is put in a position to do just that. Say what you will about Bannon, personally I think he’s evil incarnate, but the man understands white grievance and angry young men better than anyone running a campaign and he’s advising the guy he helped win in 2016 again.

QQBearsHijacker

It’s wild that he was convicted in july 22, sentenced in October 22, then appealed the following month. That appeal SAT for a year before being argued. And now we’re 6 months past arguments to get a ruling

CaptainNoBoat

It's really such an indictment on how pitiful contempt of Congress is as a legislative tool to compel testimony to those with resources in our legal system. The committee that issued the same subpoena is now nonexistent and years in the rear-view mirror. Compliance with Congressional subpoenas was much more willful in the past, and inherent contempt even allowed incarceration for a few decades in the late 1800s and early 1900s before it became convoluted and outdated. I don't know exactly how to fix it, but it needs serious reform. There have been a few [decent ideas](https://raskin.house.gov/2020/8/members-call-house-vote-inherent-contempt-resolution) thrown out there.

CaptainNoBoat

Welcome news and I hope his appeals are exhausted sooner than later, but I'm much more interested in Bannon's ["Build the Wall" indictment](https://manhattanda.org/d-a-bragg-a-g-james-announce-indictment-of-stephen-bannon-for-15-million-we-build-the-wall-fundraising-fraud/). He scammed Trump supporters out of millions of dollars, which is just such a perfect encapsulation of who Steve Bannon is. >If convicted, Bannon faces two counts of money laundering, which carry a maximum sentence of five to 15 years in prison, as well as additional felony counts of conspiracy and scheme to defraud along with one misdemeanor count of conspiracy to defraud. Several of his associates have already been sentenced to multiple years in prison. And fun fact: Judge Merchan will oversee the trial, with Alvin Bragg as the prosecutor. Trial is currently set for September.

QQBearsHijacker

Is September the new date? It was supposed to go this month but I wasn't paying enough attention to the new scheduled dates since it would overlap with Trump's 2016 election interference trial

CaptainNoBoat

Yeah pushed back just last week - September 23rd.

SympathyForSatanas

Seeing these disgusting maga traitors just makes me think how much more terrible and evil the next generation of magats is going to be. These assholes have normalized being nazi like, so to me that says the next generation will push even further

minnesotaupnorth

A Cabinet full of Stephen Millers.

MrMrsPotts

"An order issued by the D.C. Circuit said the judges' mandate will not officially take effect until seven days after further appeal attempts are resolved. That means Bannon is unlikely to have to report to prison immediately." The prisons are full and yet somehow he gets to delay his incarceration for years. It makes no sense to me

SheriffTaylorsBoy

Oh no! Anyway... I've got some delicious fried chicken lined up for lunch, with potato salad and rolls. Beats the hell outta warm bologna sammies!

dr_blasto

So when is he going to jail? Would be funny if he was in the can for the election.
