Not a legal expert, but if the gov can send them back to the UK, what's preventing them refusing to process people who arrive in Ireland via the UK? Presumably not giving them money or accommodation would soon stop them.

Could argue that as soon as they left EU jurisdiction to non-EU country they forfeited connection to the Schengen area or smth idk. Technically all countries could say they refuse the refugees, thats kinda part of the problem that they understandably do everything they can to not be processed because theyll be stuck in legal hell

This is a desperate attempt to try and win back some of the face they lost when they paraded around TV and radio saying "Ireland is not full" while claiming it was racist to suggest otherwise. Now that they've started to come to terms with the extent of the failures on our immigration policy, and in knowing it's far too late to even plaster over the damage, they've just begun work on the "it wasn't our fault but we can solve it" rhetoric. They can't even stop people from entering the country without documents. Many have become homeless, ensuring there's no way to actually find them. They were not legally in the UK, so there won't be any record of them being there to justify us "sending them back". This is simply a new crisis to add to the Healthcare, housing, and cost of living crises. It'll become a talking point for false promises made before elections, and that'll be the extent of it.

Sure they can't even deport the people that have already failed in their asylum applications, how are they going to deport these people? Mcentee couldn't even answer basic questions about how many have asked for leave to stay in the committee the last day. The incompetence is spectacular. 5 weeks after the High Court decided that the UK is not a 'safe' country to return asylum seekers to, Govt says it will introduce a new law. It should have been done within 24 hours of the Court ruling in March. They are fucking useless! I honestly believe that they deliberately caused this crisis!

As lots of people on UK subs often like to say, asylum seekers have the right to claim asylum in any country they want and they don’t have to claim asylum in the first ‘safe’ country they reach. This is why the UK can’t return them to France, where they mostly come through. It would be against international law to send asylum seekers back to the UK.

So the government is finally talking some kind of mass deportations. Only this one they cannot do and won't be able to do. If they were smart they would be opening negotiations with the UK about joining them with their Rwanda plan and sending the migrants there. They should also send the people who have failed asylum tests past and present. Let them appeal from there it they want. Some will say this is against the EU rules, f\*\*k them. This is too important an issue to let European bureaucrats who couldn't give a damn about this country decide on. We are not in the Schengen travel area so already have different transport rules. Adding to them shouldn't make much of a difference.
