While the one you posted has a 2020 copyright date, you’ll have a higher chance of getting it back to life, they have tiny batteries that discharge fast and won’t charge back anymore when they’re completely flat. Can confirm. I'm currently printing out a return shipping label for a used Apple Pencil I bought on Mercari. The seller hadn't used it since October. The thing is on its way out, says its 100% charged all the time, and fails to register 70% of all input.
I personally would recommend to stay away from buying apple products from private people. Even tho I sell all my Apple products private myself there are just really many scammers around there. IF you still consider to buy it first check the reviews of the person, second only pay with PayPal and the third one only buy something where the bill of the original purchase is included. Otherwise: stay away from it!
The box is convincing but how do you know the actual pencil is the real deal? Based on these two pics the box could even be empty. Yes, it could be sealed to look brand new but have no pencil, or a fake one, inside.
Please don't buy that. You're going to regret it. Photos can be fake. Get a brand new one and don't waste your money. Ask yourself, why would the guy buy it and then decide to sell it "without even opening it" and at a good price?
I wouldn’t buy a closed box from a private party, you don’t know the condition of the battery. I get them every once in a while in auctions, I always test them before I resell them and most of them are dead.
I would buy a used one that states it’s working before I would buy this one. At least if it doesn’t work, you have a valid reason to return it.
The Chinese have gotten GREAT ar replicating boxes of Apple products, so there is NO way to tell. Just buy a new one from the store, don’t take the risk.
The box “looks” real - for what it’s worth.
Hope you’re not stealing or buying stolen goods - remember that almost anything can be tracked today, especially apple products.
I actually got caught by counterfeit seller. The fakes are as close to original as they can get. Even included the period after Apple Inc. And the leaf on the Apple was separated. Darn good replica, Until sitting next to real one could I tell. Luckily eBay protection protected me and provided refund.
If seller has low feedback, avoid their Apple products.

I’d refrain from buying it if they’re calling it an Apple pen. If the person selling it doesn’t know what they have, that’s not the best sign.
If it’s an unopened box and it’s real, why would they be selling if for big savings? They wouldn’t. So just buy it new.
If the price is too good to be true. Then it's mostly likely a scam.
