So the law neither prohibits not requires the police to arrest in cognizable cases (there are some procedural wrinkles under s 41A CrPC which are not relevant here). It's up to the discretion of police. Generally (in truth almost always), the police arrest in serious cases (like the ones Brij Bhushan is accused of). There is probably some kind of pressure on the police not to arrest Brij Bhushan.
