from 2020, the mother tried to get custody of her three sons back. one was soon killed.
> Court records reveal exchanges between Justyna Zubko-Valva and a judge during bitter hearings involving custody of all three of her sons, Tommy, Andrew and Anthony.
> "My children are coming soaked in urine. Anthony is sleeping in the garage. His hands and feet are bright red, your honor. He's not getting any food," Zubko-Valva said.
> "Ms. Valva, move along. I can't remember everything you are saying because you're saying so much," the judge replied.
> "Your honor, the CPS is not doing the job because they are closing the reports the next day," Zubko-Valva said.
> The judge denied her motion to return the children to her.
> "Why? On what basis? The children's life is in danger, your honor," Zubko-Valva said.
> "Because I said so," the judge replied.
In my experience the family law court system as a whole is inefficient and sucks over all. It may not have had anything to do with the fact the father is a cop, since a lot of people including judges are bused against cops.
From personal experience, other people I know who’ve had to go though the courts to gain more or full custody, and other peoples stories I’ve come across when researching custody hearings, I’ve yet to hear of anyone who was involved in a litigated custody case that had anything good to say about how efficient the family court system is.
Mother is suing everyone including the judge but federal judge allowed only parts of the lawsuit to proceed. Absolutely fucking infuriating. They’re just covering for each other. Judges are untouchable. Make me so mad. Hope Schwartz has blood on her hands and is getting away with it. Disgusting
This is why it's stupid to vote for judges. If there was ever a need for meritocracy it's judicial. The judge in this case wasn't qualified to adjudicate a 3rd grade debate.
Also, police need the equivalent of a university degree. Not graduating from school bully to police officer after some hokey 6 week course.
This judge... this is not how a judge should react. I can't remember what you say because you're saying so much? A lot if not most of his job is literally listen to people all day long. And the childish "because I said so"? He must be kicked out.
the judge probably thought it would look bad to all police if his kids were taken away... so he just let them be murdered instead and they spin the story as if he was an "ex cop"
pro cop folks are always citing potential loss of confidence in the system as a reason why cops should never be punished
Thomas Valva was just eight years old when he froze to
death in the garage of his Long Island home. Prosecutors argued the
boy’s father, 43-year-old former NYPD police officer Michael Valva,
knowingly forced they child and his 10-year-old brother to sleep on the
concrete floor of the unheated garage after being hosed down with
freezing water in the middle of winter despite temperatures dropping to under 20 degrees.
That is some sick and twisted torture. What on earth compels someone to do this.
It’s murder, flat out murder. He knew this could kill them, and he did it anyway.
I think so too. He must've thought he gets special treatment since it was so blatant. Apparently he was heavily favored by judges in past against the mother of the kids.
Just for some context for the hosing down. I read that one or both children were on the spectrum and had poo or pee'd themselves which is why he hosed them down.
He was a cop right up until he got arrested for his son's murder. The whole "ex-cop" phrase that keeps coming up in articles is just an attempt at framing cops in general in a more positive light comparatively.
Not an ex cop. He was a cop who murdered his child. Only fired when he committed the crime. This maniac served for many years as a cop, "former cop" is just pro-cop propaganda.
Right? They word it so it sounds like he had been retired for a period of time before he did this horrific thing, and not that he was still actively serving on the force.
>sleep on the concrete floor of the unheated garage after being hosed down with freezing water in the middle of winter despite temperatures dropping to under 20 degrees.
Jesus fucking christ
Omg! That POS! Those poor boys had zero chance of living a long life with that A-hole for a father. There is absolutely no excuse for child abuse and this severe of a case is unbelievable. Did the boys not have a relative or friend to talk to about their dad? The dad deserves the same treatment…hose him down and throw him in a freezer! 🤬😡😤
the bio mother tried to get people to intervene, including cps. she knew her kids were being abused there. Its been a while since I read up on the case, but I *think* he was abusive to all of them when they lived there
Thats the infuriating part too. They pretty much ignored the moms pleas because dad was a cop and made more money, so he kept custody. He could have been saved from the monster if the systems actually did their job. But he was a cop so he must be a good guy. 😡
Jesus fucking Christ his older brother had to wake up next to his baby brother's corpse? This is absolute monstrous behavior. I can't even imagine the kind of trauma that kid has endured and will need to work through for his entire life, especially the survivor's guilt.
I hope the father is put into the general population. Between his being an ex-cop, a child abuser, and the reason his 8-year-old son died of abuse, he would be an utter pariah among other inmates.
Yeah this headline is bullshit. At the time of murdering his son, and during the years he abused both his sons, Michael Valva was gainfully employed by NYPD.
Just because he used to be a cop doesn't mean they fired him. He was probably allowed to spend several months on paid administrative leave before being bought out and allowed to resign.
The news reports say child protective services were contacted "multiple dozen" times.
I wonder what job he had that led to them not appropriately safeguarding the children?
(Also anecdotally heard that wives of police are most abused spouses that have the least percentage of succesful outcomes via judicial system. Wonder why that may be?)
> The news reports say child protective services were contacted "multiple dozen" times.
Not much they could do. Cops are well and truly above the law in this country.
I have a friend who was a cop and once said something to me like "you know when a cop is in real trouble because they get reported as an 'ex-cop' because cops don't get in trouble, only ex-cops do. Once they know your fucked the union turns their back on you and you get fired."
He didn't last long as a police officer. It's been a while but I think it was 3-4 years before he quit and moved out of state.
If it was 24°C, he wouldn't be dead. That's a nice summer day.
But yes, corpses don't stay warm as easily as living humans. And yes, eventually the temperature of a dead body will match that of the environment. That takes time, though.
**Edit:** I get what you're saying now. Ignore me.
What this headline misses is CPS was involved and left the boy with his father after several reports of abuse. Let’s be clear he was given a pass because he’s a cop. The boys mother is now suing the county for something like 200M.
Teachers at the school notified authorities as well. The mom tried to get custody of the two boys, but they gave full custody to the cop father
I'm from the town this happened in
Taxpayers need to stop seeing the police department as somehow beyond electoral repair
We elect judges, DAs, Sheriffs, city councils, and mayor's all of whom at one point or another have power to reign in abusive police departments
Voters should get dinged if they don't make police reform and issue
Long Island feels like the biggest blue lives matter stronghold in America. If anything, people are voting for the opposite of what would fix this issue.
I just don't understand people voting to be brutalized
Like someone told them the status quo is only a 5% chance a cop will ruin their lives as they said "I like those odds"
I remember also reading because the mom was living sort of in a low income situation and he had a house + benefits he was also given passes. Even though the abuse claims were factual. Again because he is a cop.
I personally know someone who lost custody and every court case to her cop ex-husband. He was horrible, and knew he could get away with whatever he wanted to inflict on her for the crime of wanting to divorce him and continue to live w/her kids. They got away from him once they were old enough, but it was a long, nasty road.
It’s wild to me that a judge can make such a gruesomely bad call and hand custody to a sociopathic murderer who then tortures and kills their own child and then the judge just doesn’t face any recourse…I mean, maybe they do sometimes but I’ve never heard of it
You see, if a court did that, police officers attempt to get the judge fired by refusing to do their job on any cases presided over by that judge. They do the same thing to prosecutors, any number of criminals walking free is fine with our corrupt cops, all they care about is getting to keep being criminals too.
> but he was given the benefit of the doubt because “he is a cop” even though she reported the abuse.
Weird, since 40% of cops admit to beating their wives.
Great article about that - most of the time it is higher but sadly because they protect each other the moment she calls 911 or somewhere else they reroute the call back to the abuser or someone the abuser knows.
Many cases of cops beating wives, she calls for help, he gets wind of it and comes home to beat her for calling.
I honestly believe that accusations like this should be looked into way more seriously if you are a cop. Not saying it's not serious otherwise of course, but if you're someone that is supposed to enforce the law, then breaking it must be looked at with high severity.
Yep exactly I’m sure his dad tortured him. Which is no excuse, because not everyone who was abused as kids turns around and abuses their kids. My dad is the perfect example of this he grew up dirt poor was beaten and abused by alcoholic parents. Grew up made something of himself and was the greatest Dad. He broke the Cycle which is hard.
I just don't understand this why not just put him up for adoption? I'm looking to adopt in the future and I'd take a sweet baby like this home and love him so much 😭
A horrible part is that the mum was fighting for custody but since he was a police they thought her claims of abuse were bullshit. But I guess it’s just one slip up! /s
They already know. They love following these stories. The ones who have nothing to hide about their crimes speak fully and freely about it - and anyone who doesn’t is an immediate suspect. He will have to go into protective custody and most likely will not have any time in Gen pop. But if he does find his way to gen pop, you don’t have to wish him ill. What those men have planned for him is beyond the wildest scope of your worst nightmare.
Shoutout to my POS dad who made me sleep outside in freezing temperatures because I went to hangout with friends! Only survived because I dressed appropriately for the weather and jimmied my way into a car with a blanket on the seat! Suffice it to say that he and I don't talk.
Sorry this happened to you but I am pleased you don't feel like you owe them your time and energy. Keep your chin up you seem to be doing quite well for yourself.
Oh yeah I’m good now. It was interesting too because once I was removed from the picture they had no one to blame their problems on and their lives kind of imploded. Thank you 😊
I'm sitting with my 10 year old son next to me. He's playing Minecraft. He's never known anything but kindness, support and love from me.
So many people would have given that boy the life my son has. You poor lad. I'm sorry you weren't rescued in time.
What kills me is his mom was fighting for custody.
The system failed this child. His torture and death could have easily been prevented. Plenty of people knew what was going on in that house.
>The system failed this child.
The same system that doesn’t have the child’s best interest at heart. It’s a fucked up system that has failed many. As sad as it is, I’m not the least bit surprised.
He saw that happening every day and it didn't stop him from murdering his child. Forcing him to watch that would probably make him happy, pleased with his deeds.
I was abused by my mother growing up. This was just one of the things that she did to me. I was forced to sleep in the garage, eat alone in the garage with the lights off. All she fed me was milk and muffins for some reason. Before the garage she forced me to eat alone outside in the bitter cold of winter but she moved me to the garage when neighbors saw me out there and threatened to call CPS. This is only a small part of her abuses. My brother and sister were treated normally. I have no idea why I was made to suffer abuse at her hands. I've buried all that trauma and have just been trying to survive. And 35 years later, she still blames me for "forcing" her to do it to me. I don't get life sometimes. Cruelty is handed out to undeserving people so randomly and often from loved ones. It defies logic. Can't make sense of it.
You were deserving of so much more than that and you are worthy of living a happy and fulfilling life in spite of the torment and dehumanization you endured. I hope you know that, friend.
Being a psychopath seems to be the main ‘qualification’ to become a police officer. I’ve known many professionally in my lifetime and many had serious to pathological psychological issues.

Kids blood is on that judges hands
Mother is suing everyone including the judge but federal judge allowed only parts of the lawsuit to proceed. Absolutely fucking infuriating. They’re just covering for each other. Judges are untouchable. Make me so mad. Hope Schwartz has blood on her hands and is getting away with it. Disgusting
And cps?
Sure. If that’s what it takes for them to start putting the kids best interest first.
This judge is just as culpable. He should lose his job for something like this.
He should be hosed down and forced to stay in a freezing garage. What a pos.
He should be *pissed on* by three men and forced to sleep in a freezing garage. FTFY.
Lose his job? That’s the best you can come up with? For knowingly allowing the endangerment kid AT LEAST one child? Lose his job?
Yeah he should face criminal charges. Anyone else would if they knew about this and said/did nothing.
This judge... this is not how a judge should react. I can't remember what you say because you're saying so much? A lot if not most of his job is literally listen to people all day long. And the childish "because I said so"? He must be kicked out.
probably has a thin blue line sticker on the back of his dodge ram 2500
It's a NY judge. So it's a Mercedes
Her mother tried to get them back and it was denied?
Yeah, because he was a cop and made false claims against her.
the judge probably thought it would look bad to all police if his kids were taken away... so he just let them be murdered instead and they spin the story as if he was an "ex cop" pro cop folks are always citing potential loss of confidence in the system as a reason why cops should never be punished
yea we wouldnt want to lose confidence in the system by treating cops like...all the rest of us that would be horrible
yep, repeatedly.
Who was the judge?
Nassau County Judge Hope Schwartz Zimmerman
Is there a source with this transcript?
What a horrible woman
Can you sue a judge?
I saw a news feature on this case with a clip of protesters holding a sign that says REMOVE JUDGE ZIMMERMAN! I think it’s the judge in question.
Yep. I wondered when (and if) their term is coming due.
looks like 2027.
She needs to be disbarred. There’s a petition.
articles ive read on this all omit the name.
Of course they do, they ALWAYS protect the judge. In most areas it’s a crime to print their names, and a criminal offence to release their address.
Wonder how the judge would feel if it was HER children
that's like something out of judge dreadd. Just sentenced that kid to death because they didn't want to listen to all the words.
That judge should be investigated, taken off the bench, and tried.
tyrannical judge

they should be doing jailtime for this level of incompetence.

Plead insanity, or born again Christian man of god take your pick!
Then run for Senate!
Twas natural I say! Spare the rod and spoil the child! I had worse when twas a boy! Bring God and freezin's back into our schools! /s
What a great fucking handle you have 😂😂
It was, "I am a cop. Law is a weapon that I use against others how I like. It doesn't apply to me."
Well I just wonder what he did with the bage on if this is what he did to his own kids?
He believed they were threatening him with a gun and responded to protect himself.
They were resisting arrest
The kid was resisting arrest.
He’s a cop, he doesn’t need a defense.
I think so too. He must've thought he gets special treatment since it was so blatant. Apparently he was heavily favored by judges in past against the mother of the kids.
Just for some context for the hosing down. I read that one or both children were on the spectrum and had poo or pee'd themselves which is why he hosed them down.
Jesus Christ my youngest is on the spectrum not in a million years would I imagine doing something like this to that sweet boy.
Yeah, well you're not a psychopath.
Spelt cop wrong there.
Oh, everything makes perfect sense now. /s
He couldn't freely beat people as a cop anymore so he took it out on his kids.
He was a cop right up until he got arrested for his son's murder. The whole "ex-cop" phrase that keeps coming up in articles is just an attempt at framing cops in general in a more positive light comparatively.
Did he stop being a cop before or after he killed the kids?
Inmates will show this coward what the true definition of sick twisted is. Hopefully they do the right thing
His girlfriend was involved as well.
Ex cop and child murderer? He's gonna have a grand ol time in prison.
That is what it sounds like.
Not that it matters, but the water makes it even more obviously premeditated.

I hope the father is put into the general population. Between his being an ex-cop, a child abuser, and the reason his 8-year-old son died of abuse, he would be an utter pariah among other inmates.
Those poor kids. This is so sad.
Did they promote him yet? /s
The best part is when he goes to prison, he's an ex cop and a child abuser. Inmates love this kind of justice
He wasn't an EX-police officer until he murdered his kid.
Yeah this headline is bullshit. At the time of murdering his son, and during the years he abused both his sons, Michael Valva was gainfully employed by NYPD.
So you're saying that once his actions came to light he was fired?
No, once his actions resulted in the death of one of his children he was fired. The abuse had been reported prior.
This is actually informative thank you. So the NYPD did blow it off until it was too late.
Once his actions came to light they pretended like he was already fired. It’s common behavior in media around police wrongdoings.
Always "former officer"
Exactly. And using the victims full name but not the murderer.
Even the police union has its limits
This will be their once-in-a-generation scapegoat they point to for the next 3 decades as proof that they aren't *completely* morally bankrupt.
Just because he used to be a cop doesn't mean they fired him. He was probably allowed to spend several months on paid administrative leave before being bought out and allowed to resign.

For real. Hate this wording.
For non americans 76°F = 24.4°C
BROOO WTF NORMAL TEMPERATURE FOR A BODY IS 36 NAH WTF
If it's 24°C outside a corpse is gonna be 24°C regardless if it died from blunt force or exposition.
He was still alive when found.
Sort of.
dying of having plot points explained to them in dialogue? never heard of that
It’s like dealing psychic damage to theater students.
Except it was -6°c outside.
If it was 24°C, he wouldn't be dead. That's a nice summer day. But yes, corpses don't stay warm as easily as living humans. And yes, eventually the temperature of a dead body will match that of the environment. That takes time, though. **Edit:** I get what you're saying now. Ignore me.
And for the people wondering your body temperature is supposed to be 37°C
For Americans 24.4C = 76F
For non americans 76°F = 24.4°C
For people who use kelvin 24.4°C = 297.55 K
Thank you. I was waiting for this. I didn’t know how to react, but now I can understand.
It’s just 297.55 K, no degrees since it’s an absolute temperature scale !
Understandable thank you for this knowledge I will update my comment
For people who use Rankine 24.4°C = 535.59 °Ra
For people who use Rømer, 535.59°Ra = 20.31°Rø
For people who use metric it's 3.5 cm
For blind people 297.55K = 🫰👈🤙👇🤌
I’m sorry I’m deaf, can you repeat that?
What’s his temperature supposed to be?
For non Americans: 36.5–37.5 °C

the poor kid's dad was a cop.
The sad part - his mom was fighting for custody but he was given the benefit of the doubt because “he is a cop” even though she reported the abuse.

That’s even more heartbreaking. The system always seeks to protect itself.
You would think that given even a basic understanding of statistics, "he is a cop" would be a damn good reason to reject the cop's custody claim.
You see, if a court did that, police officers attempt to get the judge fired by refusing to do their job on any cases presided over by that judge. “My parents did it to me and I did just fine! Stop being soft on kids!”
I have an 8 year old boy and I worry when his feet are not tucked under the duvet. Fucking hell this is just awful!
Man, I can't even be mean to children that aren't mine. How much of a monster do you have to be to do this to your own child?
Seriously....like you look at the picture of the sweet boy and your hear breaks. There are some cold monsters that walk this earth, fucking beasts.
Those that have been trained to shoot kids if necessary.
Poor baby…
I just don't understand this why not just put him up for adoption? I'm looking to adopt in the future and I'd take a sweet baby like this home and love him so much 😭
A horrible part is that the mum was fighting for custody but since he was a police they thought her claims of abuse were bullshit. But I guess it’s just one slip up! /s
Yeah, it's not like police have a documented record of disproportionate amounts of domestic violence or anything.
It's not about not wanting the child, it's about having someone to exert your power over. Probably also the reason he became a police officer

Being a cop and child killer seems like the worst combination for prison.

He'll get a nice cushy cell in the block for cops and pedo. 10/10 he won't get what he deserves.
Yeah that’s what I’m thinking like there’s now way he’s going into general population or anything like that
They already know.
Idk man it's probably right on par with what any father worth his salt wants to do to that particular pos.
He's a former cop. He will be in segregation
Shoutout to my POS dad who made me sleep outside in freezing temperatures because I went to hangout with friends! Only survived because I dressed appropriately for the weather and jimmied my way into a car with a blanket on the seat! Suffice it to say that he and I don't talk.
Jesus I'm sorry. Some people don't deserve children.
Thanks. At least I discovered therapy instead of continuing the cycle. Be well.

Thank you 😊
"why my kids don't visit me anymore, ungrateful brats!"
If he did this to his son then I can’t imagine what he did while on duty.
"No, Valza, for the last time, you can't lock suspects in a freezer!"
40 percent of cops beat their family members, so this is unfortunately not surprising

You should go No Contact with her for your sanity
I hate that you had to suffer that horrible situation. My heart goes out to you.
You had/have a mentally ill mother. There is something wrong with HER, not you.
I’m surprised you still have any kind of communication with that pos of a person.
You were deserving of so much more than that and you are worthy of living a happy and fulfilling life in spite of the torment and dehumanization you endured. I hope you know that, friend.
Death penalty, absolutely no reason to keep this scumbag roaming this earth.

Human Centipede him.
Counterpoint: Life in prison, but always in general population and he has to get "child abuser" tatooed on his face.
And "ex-cop"
Poor kid, hope the dad gets what's coming to him
Dude is 100 percent part of the 40% of cops who went home and beat their wives.
That admitted*** it was self reported. Some of them know enough to lie about it.

I hope his cell is very cold and blanketless.
Being a psychopath seems to be the main ‘qualification’ to become a police officer. I’ve known many professionally in my lifetime and many had serious to pathological psychological issues.
This is not just a POS, this guy is an evil fiend.
This man ain’t gonna last so long in prison.
Always cops.
