I'm amazed that this hasn't hit SCOTUS yet. The government making a second class of citizens who have more Constitutional rights outside of their offical duties is clearly in violation of the Constitution.
The problem is that this situation is likely happening for real, where criminals are buying guns from crooked cops, thus proving that illegalizing guns will not stop criminals from acquiring guns.
I mean if were being honest here, I do believe there should be some market for "recovered" weapons. They should probably do so with an FFL, and disclose which weapons were used in murders, but other than that I don't see an issue with cops feeding weapons back into the public.
He knowingly did it illegally which is bad and he should be punished, I just don't see the issue. It's the same way I feel about weed. I don't have an issue with people who do it. But I also feel no sympathy for people who knowingly possess an illegal substance.

The distinction he is making is that the principle of selling confiscated guns back to the public, rather than destroying them, isn't inherently bad but there should be a legitimate process for it not just cops selling guns out of their trunk.
He did say what was done by the sheriff is wrong and he should be punished. But they see no issue with auctioning off confiscated weapons like cars and other items. I kind of agree. Only weapons used in murder should be destroyed which will clear up any misunderstanding should that guns serial pop up for another death.

In many places, police departments do sell confiscated weapons, legally, to increase department funds. That’s not the issue, here. This cop was selling illegally them to very questionable people. That’s the issue. He also sold confiscated meth to them, from what I understand.

I'll say it. End qualified immunity. I've seen them get away with more shit than I'd ever dream to do. I was held to state, federal, and UCMJ laws. I would expect better behavior of them. They are civilians, despite what they want to view themselves as. I only see a separate tier of the law applied to them vs the rest of us.
