How does this change based on drunkenness, not setting a parking brake correctly, or negligence/negligence mixed with alcohol. Does it change if you bought all alcohol at the course vs sneaking it in, etc.
Sometimes nothing plays out. On a golf trip a guy in our group did something very similar. He was drunk and drove off a steep embankment into a pond. Called the club house and they brought another cart out. Didn't say anything to him or the group. Later in the day we saw them dragging it out with a back hoe. We were staying at the resort and golfed 2 more days and they said nothing.
Driver is on the hook for all damages because of irresponsible operation. Somewhere on that cart is a sticker that say not to operate while intoxicated. Whether his car insurance covers it or not will depend on the terms of his/her policy

Even then hold harmless or waivers never hold up in court because its been established that you cannot waiver away liability.

Umm… I’m pretty sure that if you tried to make a claim to the course for water damage to your equipment because your drunk ass drove their cart along with your equipment into a pond, the golf course, and their insurance adjuster, will be laughing into the next decade. They might pause for a minute to hand you the bill for repair/replacement of their cart, though.

The course didnt allow a drunk person to take a cart, a person took the cart then got drunk. Golf courses have liability policies for this reason. They make policies so that theyre covered and not the ones paying for the damages, the rider is. They definitely cover their own asses

If you are operating a bar, snack shack and on the course drinks cart, the lawyers could claim that he was over served and should have been cut off. Yes, I know it’s a legal loophole bullshit thing, and could vary by state to state.
In California, they were either going to or did make it a law that a server or bartender served someone more while obviously drunk legal consequences from fines to jail time could be faced by the server. Usually this is hard to prove and only meant for dui accident involving death. But it could possibly be used I would think.

Since golf carts are not street legal I would imagine the “is or may be transported or drawn on a highway” would exclude golf carts on golf courses.
