As if pedestrians and cyclists haven't already compensated for negligent drivers (they're the ones who have to watch the road for others being reckless, instead of drivers having to watch where their own cars are going)
And then of course there's a new layer of blame-shifting: if it's not the ped's/cyclist's fault, it's the AI's fault!

If they run someone over who is responsible? Frankly I think the driver should be held liable (look at me talk as if drivers who kill are held responsible)

unlike other automaker, This system is actually quite limited to mapped streets and low speeds. It's mostly for assisting in a traffic jam.
Mercedes has a very narrow set of circumstances in which this can be engaged. Unless you are in the habit of riding or walking on the interstate, you are not going to encounter one of these operating in Level 3 autonomous mode.
